August Court 1724 Lord prop.ry that now is his good rule and Government and against the form of the act of assembly in that Case made and provided &c.a Testis M. Howard Cler. pac. Dan.l Ferrill And the afd Anne in her proper person appears to the afd Indictment and Saith that She was a Servant under Confinement at the time the Child afd was begott and untill the Delivery of the same, Soon after being free marryed the begetter of the afd Child which she is Ready to prove. This Court being Satisfied of the Truth of the above alegation. Orders that the afd Clerk of Indictments prosecute y.e afd Indictment no further. Upon which Michael Howard attry of the said Lord proprietor Saith that for as much as the alegation afd appearing to the Court. The Indictment afd is no further procecuted Therefore it is Considered by the Justices here to wit at the Courthouse in the Town of Chester this Eighteenth Day of August Anno Dom. one thousand Seven hundred & twenty four that the afd Anne Sanders as to the Indictment afd She go thereof without Day and be therefrom acquitted also it is Considered that the said Anne Sanders pay the Sume Two hundred and fourty two pounds of Tobacco Costs accruing on the pmisses afd to the officers of this Court. Jam.s Smith Clk. Ordered that the afd Anne Sanders give Security for her fees above Specified. Thereupon Maurice Carty of Kent County Inholder Comes into Court and Says that he will pay all the Costs on the Indictment afd and thereupon Anne Sanders is therefrom Discharged.
that his Recognizance and his Suretys Recognizances be Discharged Garret Closey of Kent County planter at June Court last did acknowledge himself Indebted unto his Lordship the L.d Prop.ry of |
