the said case on the docket of the court of appeals, and
that after being so reinstated the said case shall be in the
same condition, and the said court shall hear and deter-
mine the said case as if said judgment of affirmance had
not been entered.

CHAPTER 225.


An act to Incorporate a company for the purpose of making
a Canal to connect the waters of Lewis creek with Indian
river and the Chesapeake bay, by Pocomoke river.

Passed Mar. 14, 1833

WHEEEAS, it is represented to this General Assembly,
that the Legislature of the State of Delaware have incor-
porated a company for the purpose of making a Canal to
connect the waters of Lewis creek with Indian river and
the Chesapeake bay, to Pocomoke river, and have appoint-
ed managers to open books for receiving subscriptions for
the purpose of cutting said Canal, and perfecting the nav-
igation thereof; And whereas, in consequence of the loca-
tion of said Canal, it will be impossible to complete the
same, unless through the aid of the Legislature of this
state— Therefore,

Preamble.

Section 1. Be it enacted by the General Assembly of
Maryland, That David K. Hopkins, John S. Purnell, Sam-
uel R. Smith, Lemuel Showell, Charles R. Henry, Wil-
liam H. Merrill, Peter Whaley, or any three of them, are
hereby authorised and empowered to act in connection

with the managers on the part of Delaware, to open books
for receiving subscriptions to the amount of two hundred
and fifty thousand dollars, in shares of twenty dollars each
share, for the purpose of cutting a Caaal to connect

the waters of Lewis creek with Indian river and the
Chesapeake bny, by the Pocomoke river, and per-
fecting the navigation of said Canal; which said books
shall be opened at such times and places, and continue
open for such time, as said managers shall appoint, who
shall give at least twenty days notice, by advertisement in
such newspapers as they deem proper, of the times and
places of opening said books; a majority of said managers
shall have power to act in all respects, as if all the said
managers were present.
