five Pounds four Shillings Curt. Money on demand with Interest thereon untill the Said Sum of five Pounds four Shillings Curt Money afd. Should be paid for Value Received by Reason whereof as also by force of the Statute in Such Case made and Provided the Said Isaac became Liable to Pay to the Said William the Said Sum of five Pounds and four Shillings Curt. Money afd. on Demand in the Said note Mentioned According to the tenor and Effect of the Said Note and So thereof Liable being the Said Isaac in Consideration thereof afterwards to wit the Same day and Year afd. at the County afd. Undertook and then and there faithfully Promised that he the Said Isaac the Said Sum of five Pounds and four Shillings Curt. Money afd. When he Should be thereto afterwards Required unto the Said William well and faithfully would Pay and Content Nevertheless the Said Isaac his Promise and Undertaking afd. in form afd. Made Little Regarding but minding and fraudulently Intending the Said William in this Particular Craftily and Subtilly to deceive and defraud the Sum of Money afd. unto the Said William hath not Paid or him for the Same in Any Sort Contented (Altho the Same to do the Same Isaac afterwards to wit the Same day and Year afd. and often Since at the County afd. by the Said William Was Required but the Same to him to pay hitherto altogether hath Refused and Still doth Refuse and Unjustly detain Whereupon the Said William Says he is Worse and hath Damage to the Value of Ten Pounds Curt Money of Maryland and thereof he bring Suit and So forth Pledges &c J: Doe & R: Roe Whereupon the Said Isaac Roads Special Bail to the Action afd. Thereupon a Certain John Carmichael of Somerset County Planter present here in Court in his Proper Person undertook for the Said Isaac Roads and Assumed upon himself that if it Should happen that Judgment in the Plea afd. Should be Rendred for the Said William Pittman Against the afd. Isaac Roads or that he the Said Issac Roads Should be therein Convict that then he the Said Isaac Roads Should Pay and Satisfie unto the afd. Wm. Pittman the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the Prison of the Sheriff of the County afd. in Satisfaction thereof or that he the Said John Carmichael will do the Same for him &c And the afd. Isaac Roads by William Allen his Attorney Comes and defends the force and Injury when &c. And Saith that he Cannot deny the Action afd. of the afd. Wm. Pittman nor but that he did Assume upon himself in Manner and form as the afd. William Pittman Above Against him hath Complained and as to the Damage of the Said William by him by Occasion of the Premisses in that part Sustained the Same Isaac Siath and Acknowledgeth that the afd. William hath Sustained Damages by Occasion of the Premisses beyond his Costs and Charges by him about his Suit in that part Apposed to five Pounds four Shillings Curt Money And no Judgment for those Damages above Acknowledged together with his Costs and Charges afd. to him to be Adjudged Therefore by Consent of the Partis afd. it is Considered that the afd. Wm. Pittman Recover Against the afd. Isaac Roads his Damages afd. to the afd. five Pounds four shillings Curt Money by the Same Isaac in form afd. Acknowledged 201 as also Pounds of tobacco for his Costs and Charges afd. to the Same William at his Request by this Court now here of the Assent of the parties afd. Adjudged which Certain Damages in the Whole Amount to five Pounds four Shillings Curt Money & Pounds of Tobacco and the afd. Isaac in Mercy &c
Starling of a plea wherefore with force and Arms he the Said Jacob at the County afd. one Red Roan Gelding the proper Gelding of the Said Aaron of the price of fifteen pounds Current money of Maryland One Black Gelding the proper Gelding of the Said Aaron of the price of fifteen pounds Curt Money afd. & One dark bay Gelding the proper Gelding of the afd. Aaron of the price of fifteen pounds Curt. Money afd. did take Lead away Impound and Abuse and other harms to the Said Aaron then and there did to the Great damage of the Said Aaron and Against Our peace that now is &c. And the Same day is given to the afd. Aaron here &c. Att which day here Came the afd. Aaron Starling by Wm. Hayward his Attorney and the Sheriff to witt John Dennis Gent now here Returned that he had taken the afd. Jacob Cullen whose body here at this day he had Ready to Answer the afd.
