June Court 1761 91 that he this day heard the Said William Furnis the Present Possessor of the Same Land held then by his Said Grandfather and William Thomson now in Possession of the Land then held by the Said Andrew Thomson Severally Acknowledge in the Presence and hearing of Capn. Ephraim Wilson and Messrs. Levin Wilson, William Wheatly and Samuel Wilson that the Same tree was the bounder Between them and Concerning the Said Bounder this Deponant further Saith not But at a marked Red Oak with Sixteen Notches being between the Same Land of the Said William Furnis and the Land of Joseph Tilman Called Amitte Standing on the North Side of Back Creek Branch near the point Between two dreans both tending Northerly of the Same tree the Said James Furnis this Deponant Saith that thirty years Standing past or upwards he Saw an old Dead Stump ^ near the Said Red Oak which James Strawbridge Patrick Mathews and William Furnis told them was the Last Bounder of a tract of Land Called Amitte and that the Same was the divisionall tree Between the Land of Furnis Called Double Purchase and the Said Land Called Amitte and this deponant further Saith that they the Said James Strawbridge and Patrick Mathews and William Furnis Marked the Said Red Oak in the Room of the Said Old Dead Stump in the Presence of this deponant and this deponant further Saith that he hath often Seen the Said Red Oak Since and the Same hath always been Acknowledged to be the Last Bounder of Amitte and the division tree as afd. and further Saith not this 18th day of Febry Anno Dom. 1761 James Furnis The Deposition of Aaron Tilman of Somerset County Aged Sixty four Years or there Abouts being Sworn on the holy Evangelist of Almighty God deposeth and Saith that about forty Years Past he Saw a Marked Oak which he Imagined was a bounder but if so he knows not What which tree Stood on a Point of Land of the South Side of Back Creek and of the West Side of A Gully Issuing from the Said Creek and Running Southerly Between the Lands of Levin Wilson and William Furnis and further Saith not this
Evangelist of Almighty God Saith that About forty Years past one James Strawbridge Informed him that Mr. Ephraim Wilson made a Resurvey on his Land on the South Side of Back Creek at Which time the Said Wilson Settled a Post as a divisional Bounder Between his Land and a tract of Land Called Fair spring then in the Possession of the Said Strawbridge but now in the Possession of the Present William Furnis And this deponant further Saith that the Said Strawbridge Informed him that he was Present at the Setting of the Said Post which as this Deponant was informed was Set in the Spot where there Appeared then to be an Original Bounder and this Deponant further Saith that he hath many times Seen the Said Post Standing in a Piece of Marshey Ground about ten feet from the Bank of the South Side of Back Creek below the Wading Place and about thirty five Yards to the Westward of a Small Gully Issuing from the Said Creek & Running Southerly Between the Lands of Levin Wilson and William Furnis and this deponant further Saith that he hath Several times Since been Shewed the Said Post by his Brother William Furnis decd. who told him it was the Beginning Bounder of the Said William Furnises Land Called Fair Spring and further Saith not Taken the 13th of May Anno Dom. 1761 James Furnis The Deposition of William Polk of Somerset Aged thirty Years or thereabouts being Sworn on the holy Evangelist of Almighty God Saith that About November Last he was Imployed by Mr Samuel Wilson to Make a Resurvey on a tract of Land Called Double Purchase and being Ordered by the Said Wilson to Set a Course to Strike a Beach of the South Side of Back Creek Supposing the Same to be a Bounder of a tract of Land Called Fair Spring the Land of William Furnis tho Possessed by Isaac Holland and when this deponant Came to the Said Beach he was met by the Said Isaac Holland Who told this deponant he at was Rong and Shewed him another Beach ^ a Small Distance and told him that the Same was a Bounder of the Land he Lived on which is a Large Spreading Beach Standing on the Very Edge of the Bank a Small |
