March Court 1761 Stump which Stump Stands on the South Side of Thomas Lindseys plantation and About five or Six Yards to the Southwestward of a white Oak which was on this day Marked by the order of Henry Cohoon and this Deponant further Saith not Somerset County fst the Deposition of John Cottingham Aged forty five or there about being Sworn on the holy Evangelist of Almighty God deposeth as follows Vizt that about Sixteen Years Agoe he heard Thomas Cottingham Son of John Cottingham Say that he Cut A Red Oak for Garden punchens which Caused his father to be Angry with him and to tell him it was a Corner tree of his uncle Charles Cottinghams Land Called Boston And this Deponant further Saith that Thomas Cottingham Shewed him the Stump of the tree and that he Saw Some Marks in the Said Stump which Stump Stands on the South Side of Thomas Lindseys plantation And About five or Six Yards to the South Westward of A White Oak which was this day Marked by the order of Henry Cohoon and this Deponant further Saith not Somerset County fst The Deposition of Sampson Wheatly Aged fifty Years or thereabouts being Sworn on the holy Evangelist of Almighty God Deposeth as follows Vizt that About fifteen or Sixteen Years Agoe he heard Thomas Cottingham now deceased Say that he Cut Down a Red Oak that is Discribed in William Addams and John Cottinghams Depositions and that his father or his uncle Charles Cottingham but which this Deponant does not Remember told him it was a bounder of Charles Cottinghams Land and further this Deponant Saith not Somerset County fst The Deposition of Charles Cottingham Aged forty Seven or there about being Sworn on the holy Evangelist of Almighty God Deposeth as follows Vizt that About Sixteen Years Ago his father Shewed him A Red Oak Stump and told him it was a bounder of A tract of Land Called Boston And the afd. Stump Appeared to be Marked with Sixteen Marks and this Deponant further Saith that the afd. Stump is the Stump discribed in Sampson Wheatlys and William Addams depositions And this Deponant further Saith not This to Certifie that on these days to wit on the tenth day of September And on the Eleventh of November in the Year of our Lord God One thousand Seven hundred and Sixty Agreeable to our publick Advertisement Set up at the Great Church Door the on the Eighteenth day of August Last past we did meet on the Land Called Chesemans Chance in the presents of Complainant and Defendant and took the Depositions herein Mentioned to wit the Depositions of William Addams George Wilson, Thomas Cottingham, John Wilson, John Cottingham Sampson Wheatly and Charles Cottingham Given under Our hands and Seals the day and Year above Written William Turpin {Seal} Josephas Bell {Seal}

Land may depend We therefore Require you or Any three or two of you at Some time and place as to You or Any three or two of you it Shall Seem Convenient you meet on the afd. Land Called Greenfield or Any other Land on which the Bounds of the afd. Land may depend You first haveing taken your Oaths on the holy Evangels of Almighty God According to Act of Assembly in Such Case made and provided and there Cause to Come before you or Any three or two of you all Such Evidences as Shall be to you or Any three or two of you Nominated by the Said Complainant or Defendant and that you or Any three or two of you Examine them upon their Corporall Oaths to be by you or Any three or two of you Administred on the holy Evangels of Almighty God in the presence of the Complainant or Deft. if Any Touching the truth or Remebrance of their knowledge or Any thing that may Relate to the Cause afd. and that Reduceing the Severall Depositions into Writing you Send the Same with this our Commission under your or Any three or two of your hands and Seals to us to our County Court of Somerset with all Convenient Speed Witness Isaac Handy Esqr. One of our Justices of our Said Court the 20th day of June Anno Dom. 1760 And now to witt at a Court of his Lordship held at Princes Ann Town the third Tuesday of March Anno Dom. 1761 before the Justices thereof Came the above Commission and Returned the Same Endorsed in Manner following with the Severall Depositions thereto Annexed August the 20th 1760 Then Came Teague Riggen and made Oath on the holy Evangelist of Almighty God to Execute the within Commission Agreeable to An Act of Assembly in Such Case made and provided before me S Wheatly September 2d: 1760 This day was the within Mentioned Samuel Adams duely Qualified to Execute the within Commission Agreeable to Act of Assembly in Such Case made and provided before me Ephm. Wilson Somerset County to witt Depositions of Witnesses Taken upon a tract of Land Called Greenfield in Somerset County the fourth day |
