@       Command was given to the Sheriff of Somerset County that he Should Take Robert Taylor
WH    Robert Taylor    Late of Somerset County planter if he Should be found in his Bailywick and him Should Safe keep
So that he might have his body before the Justices of his Lordships County Court of Somerset to be held at Princes Ann
Town in and for the County afd. the third Tuesday of March Anno Dom. one thousand Seven hundred and Sixty one to
Answer unto John Nairn of A plea of trespass upon the Case &c. And the Same day is given to the afd. John here &c.
      And hereupon the Said John Nairn Complained of the afd. Robert Taylor in the pea afd. in form following
Somerset to wit Robert Taylor Late of Somerset County planter was Attached to Answer unto John Nairn of A plea of
trespass upon the Case &c.    And Whereupon the Said John by Littleton Dennis his Attorney Complains that Whereas
the Said Robert on the fifteenth day of June Anno Dom. MDCCLX at the County afd. did make his Certain note in
Writing Called A promissory note with his proper hand thereto Subscribed bearing date the day and Year afd. at the County
afd. and that note to the Said John then and there did deliver by which note the Said Robert Obliged himself to pay to the
Said John Nairn the full and Just Sum of four pounds Sixteen Shillings and Six pence Curt. Gold of Virginia and forty three
Shillings Curt. Money of Maryland with the Lawfull Interest it being for Value Received by means whereof and by force
of the Statute in Such Case made and provided the Said Robert became Chargeable to pay to the Said John the afd.
Sum of four pounds Sixteen Shillings and Six pence Curt. Gold of Virginia of the Value of Eight pounds Curt Money of Maryland
And forty three Shillings Curt Money of Maryland in the Said Note mentioned According to the tenor of that note and
So thereof Chargeable being the afd. Robert on Consideration thereof afterwards to wit the day and Year Last afd. at the
County afd. promised to pay to the Said John the Said Sum of four pounds Sixteen Shillings and Six pence Current Gold
of Virginia of the Value of Eight pounds Curt. Money of Maryland and forty three Shillings Current Money
of Maryland in the Said Note mentioned According to the tenor of that note Nevertheless the Said Robert his
promise afd. in form afd. made not Regarding the Said Sum of four pounds Sixteen Shillings and Six pence Curt Gold of
Virginia of the Value of Eight pounds Curt. Money of Maryland and forty three Shillings Curt Money of Maryland in the
Said Note mentioned According to the Tenor of that note to the Said John hath not paid but that to do hitherto hath
Refused and Still doth Refuse altho thereto afterwards to wit the day and Year afd. at the County afd. and often Since that
time by the Said John Required to the Damage of the Said John Twelve pounds Curt Money of Maryland and thereof
he bring Suit &c.                                                                                  Pledges &c. J: Doe & R: Roe
A Copy of the foregoing declaration was made and Sent to be Served on the deft. in order for Speedy tryall    Att which
day here Came the afd. John Nairn by Littleton Dennis his Attorney and the Sheriff to witt John Dennis Gent.
now here Returned that he had taken the afd. Robert Taylor whose body here at this day he had Ready to Answer the
afd. John Nairn of the afd. plea as to him it was Commanded
           Whereupon the Said Robert Taylor at the prayer of the afd. John Nairn is Adjudged to give Special Bail to
the Action afd.    Thereupon a Certain John Dennis Junr. of Somerset County Gent. present here in Court in his proper
person undertook for the Said Robert Taylor that if it Should happen that Judgment in the plea afd. Should be Rendred
for the Said John Nairn Against the afd. Robert Taylor or that he the Said Robert Taylor Should be therein Convict
that then he the Said Robert Should pay and Satisfie unto the afd. John Nairn the Judgment of the Court thereon
or Render his body in Execution of Such Judgment to the prison of the Sheriff of the County afd. in Satisfaction thereof
or that he the Said John Dennis will do the Same for him &c
      And the afd. Robert Taylor by William Hayward his Attorney Comes and defends the force and Injury when &c.
And Saith that he Cannot deny the Action afd. of the afd. John Nairn nor but that he did Assume upon himself in
Manner and form as the afd. John Above Against him hath Complained and as to the Damage of the Same John
by him by Occasion of the Premisses in that part Sustained the Same Robert Saith and Acknowledgeth that
the afd. John hath Sustained Damages by Occasion of the premisses beyond his Costs and Charges by him about his Suit
in that part Apposed to four pounds Sixteen Shillings and Six pence Curt. Gold of Virginia of the Value of Eight pounds Curt
Money of Maryland and forty three Shillings Current money of Maryland and not More and because the afd. Robert
John denys not this but the Same Allegation Grants to be true prays Judgment for the damages above
Acknowledged together with his Costs and Charges afd. to him to be Adjudged &c
   Therefore by Consent of the parties afd. it is Considered that the afd. John Nairn Recover Against the afd.
Robert Taylor his Damages afd. to the afd. four pound Sixteen Shillings and Six pence Curt. Gold of Virginia of the Value of
Eight pound Curt Money of Maryland and forty three Shillings Curt. Money of Maryland by the Same Robert in form afd.
