County Court of Somerset to be held at Princes Ann Town the third Tuesday of March Anno Dom. 1763 to Answer unto William Miles of A plea of trespass upon the Case &c. And the Same day is Given to the afd. William here &c Att which day here Came the afd. Wm. Miles by Samuel Wilson his Attorney And the Sheriff to witt Ephraim Wilson now here Returned that he had taken the afd. John Howard whose body here at this day he had Ready to Answer the afd. Wm. Miles of the afd. plea as to him it was Commanded Whereupon the Said John Howard at the prayer of the afd. William Miles is Adjudged to give Special Bail to the Action afd. Thereupon a Certain Ephraim Wilson of Somerset County Present herein Court in his Proper Person undertook for the Said John Howard and Assumed upon himself that if it Should happen that Judgment in the plea afd. Should be Rendred for the Said Wm. Miles Against the afd. John Howard or that he the Said John Howard Should be therein Convict that then he the Said John Howard Should Pay and Satisfie unto the afd. Wm. Miles the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the Prison of the Sheriff of the County afd. in Satisfaction thereof or that he the Said Ephraim Wilson will do the Same for him &c Whereupon the Said John Howard puts in his Place Leven Wilson Gent Attorney at Law Against the afd. William Miles of the afd. plea And thereupon at the prayer of the parties afd. day is to them now here Given untill next Court to be held at Princes Ann Town the third Tuesday of June then next following in the State that now Saveing to the parties afd. &c Att which day here Came the Parties afd by their Attorneys afd. And hereupon the Said Wm. Miles Complained of the afd. John Howard in the plea afd. in form following Somerset fst John Howard Late of Somerset County Blacksmith was Attached to Answer unto William Miles of A plea of trespass upon the Case and So forth And Whereupon the Said William Miles by Samuel Wilson his Attorney Complains that whereas the Said John Howard after the first day of May in the Year of our Lord God Seventeen hundred and five to wit July in the Year of our Lord God Seventeen hundred Sixty and two at the County afd. made his note in Writing Subscribed with his Own hand Commonly Called a Promissary note bearing date the Same day and year afd. by which Said note the Said John Howard Promised to pay unto the Said William Miles or Order on Demand the Sum of four pounds thirteen Shillings and five pence Current Money of Maryland it being for Value Received by him the Said John Howard by Reason whereof and by force of the Statute in Such Case made and Provided the Said John Howard became Liable to pay to the Said William Miles the Said Sum of Four pounds thirteen Shillings and five pence in the Said note Mentioned And being So Liable he the Said John Howard in Consideration afterwards to wit on the Same day and Year afd. at the County afd. undertook and then and there faithfully Promised the Said William Miles that he the Said John Howard would well and truly pay and Content the Said William Miles the Said Sum of four pounds thirteen Shillings and five pence in the Said note mentioned According to the Tenor and Effect of the Said Note And Whereas also the Said John Howard afterwards that is to Say on the Same day and Year Last afd. to wit at the County afd. was indebted to the Said William Miles in the Sum of Eight Pounds ten Shillings Like MOney afd. for So much Money then and there had and Received for the use of him the Said William Miles and So thereof indebted being in Consideration thereof Afterwards to wit the day and Year Last |
