our appointed you or any three or two of you to be ^ commissioners to Examine Evidences on behalf of a certain Constant Disharoon of Somerset County in relation to the bounds of a Tract of Land called Askills Choice we therefore require you or any three or two of you at Some time and place as to you or any three or two of you shall seem convenient you meet on the afsd. Land called Askills choice you first having taken your oaths on the holy Evangels of Almighty God and there cause to come before you or any three or two of you all such Evidences as shall be to you or any three or two of you Nominated by the said complaint. or Defendt. & that you or any three or two of you Examine them upon their corporall oaths to be by you or any three or two of you admi- -nistred on the holy Evangels of Almighty God in the presence of the complaint. or Deft. if any touching the truth or Remembrance of their knowledge or any thing that may relate to the cause afsd. & that reducing the several depositions into writing you send the same with this our commission under your or any three or two of your hands & seals to us to our coun- -ty court of Somerset with all convenient Speed Wittness Sampso Wheatley Esqr. one of our Justices of our said court the 19th. day of March in the 12th year of our dominion &c Anno Dom. 1763 And now to wit at a court of his Lordship held at princess Ann Town the third tuesday of June being the Twenty first day of the same Month Anno Dom. one thousand seven hundred & sixty three before the Justices thereof came Louther Dasheill and Thomas Dashiell two of the Gentlement Nominated in the within commission & returned the same Endorsed in manner following with the several depositions thereto annexed May 10th 1763 Then Came Louther Dashiell before me subscriber and was qualified to Execute the within commission according to Law Thos Holbrook May 12th 1763 Then was Thomas Dashiell qualified to Execute the within commission accord- -ing to Law before Thos Holbrook A deposition of a witness Taken on the Land called Askils Choice on behalf of Con- the -stant Disheroone ^ 20th. day of June 1763 The Deposition of William Stevens aged sixty two years or thereabouts being sworn on the holy Evangelists of Almighty God saith that near thirty years agoe he was at a survey of the Land called Askills choice then in the possession of John Disheroone when the surveyor Ran a course & Distance that stop'd very near a swamp oak and sundry people who were then present told the sd. Stevens that the afsd. Oak was the second bounder it was of the afforesd Land, and that ^ then a Living Tree But is now dead the stump of which tree is the same that he shewed us where is now sett up a Lightwood post and further saith that he has been at the sd. Tree sundry times since the afsd. survey whilst the sd. Tree was living and since it has been dead and that he perfectly remembers that the sd. oak was mark'd on four sides but does not know how may notched but believes it was regularly mark'd and further saith not We doe hereby certifie that after bein qualifyed to Execute the above commiss William Stevens ion and affixing up advertisements at the parrish church and most publick places of the county wherein the afforesd. Land Lieth agreable to Law we met on the said Land ageable to the Notice given and then and there took the above Deposition Wittness our hands and seals
