-nated by the Said complainant or Deft. & that you Or any three or Two of you Examin[e]
them upon their corporall Oaths to be by you or any three or two of you administred on
the holy Evangelist of Almighty God in the presence of the complainant or Deft. if any
touching the truth or Remembrance of their knowledge or any thing that may
relate to the cause afsd: & that reducing ye severall depositions into writing you send
the same with this our commission under your or any three or two of your hands and
Seals to us to our County Court of Somerset with all convenient Speed Witness Isaac
Handy Esqr Cheif Justice of our said court the 18th day of June in the 12th year of our domin[ion]
&c. Anno Dom: 1762
And now to wit at a court of his Lordship held at princess Ann Town the third tuesday
of June being the Twenty first day of the same Month Anno Dom: one thousand Se
-ven hundred & sixty three before the Justices thereof came George Gale and Thomas
Irving two of the Gentlemen Nominated in the within commission and returned
the same Endorsed in manner following with the following deposition thereto annex[ed]
July ye 8th 1762 Then was the within mentioned Thomas Irving & George Gale sworn on th[e]
Holy Evangelists of Almighty God to Execute the within commission    Ephm. King
March 16th. 1763 We the subscribers do hereby certify that being Qualify'd to Execute
the within commission, we did on the 11th day of August meet on the Land called Bar-
-bers Rest & did take the deposition hereto annex'd, after having given publick Notice
according to the act of assembly for that purpose Witness our hands & seals
William Giles about fifty five years of Age, being Sworn on the holy    Geo Gale Junr {Seal}
Evangelists of Almighty God on the eleventh day of August Anno Dom.    Thos. Irving {Seal}
Seventeen hundred & sixty two, deposeth that about forty years ago, his father shewed
him a pine (the Stump of Which we are now at) and told him it Was the third bounder
of James Hardy's Land, & further saith not                 Wm. Giles
The Tree above mention'd is gone except a small part of the stump and there is at the
place fix'd there by the commissioners a Sassifras post markd with Sixteen Notches

Somerset fst Frederick absolute Lord And Propry of the provinces of Maryland and
Wm Furnace    Avalon Lord Baron of Baltimore &c To Ephraim Wilson, Levin Wilson,
commission &                                            greeting
affidavits    Thomas Sehon, and Whitty Turpin of Somerset County Gent

   have appointed you or any three or two of you to be our commissioners to
Examine Evidences on behalf of a certain Wm. Furnace of the county afsd: in relation to
the bounds of a Tract of Land called Furnises adventure or any other Land on which
the bounds of the afsd Land may depend we therefore require you or any three or two of you
at Some time and place as to you or any three or two of you it shall seem convenient you
meet on the afsd. Land called Furnaces adventure or any other Land on which the bounds of
the afsd: Land may depend you first haveing taken your oaths on the holy Evangelist
of Almighty God according to act of assembly in such case made and provided and the[re]
cause to come before you or any three or two of you all such Evidences as Shall be to you
or any three or two of you Nominated by the said complainant or Deft and that you o[r]
any three or two of you Examine them upon the Corporal oaths to be by you or any thr[ee]
or two of you administred on the holy Evangelist of Almighty God in the Presence of
the complainant or Deft. if any touching the truth or Remembrance of their knowledg[e]
