June Court 1763 254 Met the 11th day of June 1761 according to appointment David Polk aged fifty six years or thereabouts being Sworn saith about eight or Ten years agoe he was at the setting up of a Ceadar post as a bounder of Wm Disheroones Land and that John Christopher Senr was present and said that was the place where John Frizels bounder formerly stood and that it was a pine that he was not at the marking the sd. bounder but saw it soon after that some person told him the said Christopher that it was the bounder of Frizels lLand and John Mears being presents said no the bounder says Mears is an oak, it is a Lye says sd. Christopher the bounder is a pine and further saith not David Polke John Dishroone aged fifty two years being Sworn saith that he was present at the set -ting up of the Ceadar post aforesd. and John Christopher being there said that the bounder of John Frizels Land stood where They were going to set up the said post and that it was a pine for his father had told him soe and John Mears Being there contradicted Christopher you are a Lyar says Christopher the bounder was a pine Tree and fur -ther saith not John Disheroon We do hereby certify that agreeable to the within commission we mett on the Land therein mentioned, after having complyed with the directions of the act of assembly in such case made by setting up advertisements agreable to the said act and took the above and within depositions Witness our hands and seals this 17th day of June 1761 Louther Dasheill {Seal} Thomas Dasheill {Seal}
ye that we have appointed you or any three or two of you to be our commissioners to examine Evidences on behalf of a certain John Cottingham of Somerset County in Relation to the bounds of a Tract of Land called Boston or any other Lands on which the same may depend we therefore require you or any three or two of you at some time and place as to you or any three or two of you shall seem Convenient you meet on ye. afd. Land called Boston or any other Land on which the bounds of the afsd. Land may depend you first having taken your oaths on ye. holy Evangelists of Almighty God & there cause to come before you or any three or two of you all such Evidences as shall be to you or any three or two of you Nomi- the -nated by ^ said complainant or deft. & that you or any three or two of you Examine them upon their corporall oaths to be by you or any three or two of you administred on the Holy Evangelist of Almighty God in the presence of the complainant or Deft. if any Touching the truth or Remembrance of their knowledge or any thing that may relate to the cause afsd & that reducing the severall depositions into writing you send the same with this our commission under your or any three or two of your hands and seals to us to our county court of Somerset with all convenient speed Witness Isaac Handy Esqr Cheif Justice of our said court ye. 21st. day of Novr in the 11th year of our dominion &c Anno Dom. 1761 And now to wit at a court of his Lordship held at princess Ann Town the third tuesday of June being the twenty first day of the same Month Anno Dom. one thousand seven hundred and sixty three before the Justices thereof came Abraham Outen and Purnell Outen two of the Gentlemen |
