Ann Town the third tuesday of March then next following Twelve &c by whom &c and who neither &c to
Recognize in form afsd &c and the same day is given to the parties afsd: here &c       Att which day here
came as well the afsd: John Scarborough as the afsd: George Buchanan and William Hamilton by their
Attorneys afsd and the afsd: George and William Suggest to the court here that they have a material
Witness in this cause who is now beyond the seas without whom they cannot Safely come to tryal
and the afsd: sheriff did not send thereof the writt &c         Therefore as before it is command
-ed the sheriff of Somerset County that he should cause to Come before his Lordships Justices at the
Next Court to be held at princess Ann Town the third Tuesday of June then next following
Twelve &c. by whom &c: and who neither &c to Recognize in form afsd: &c & the same day is given to
the parties afsd: here &c            Att which day here came as well the afsd: John Scarborough
as the afsd: George Buchanan and William Hamilton by their Attorneys afsd: and hereupon the afsd
John Scarborough then and there his writt and declaration afsd: against the afsd: George Buchanan &
William Hamilton did not prosecute with effect but voluntarily suffered his suit to be discontinued
   Therefore it is considered by the Court here that the afsd: John Scarborough take Nothing by
his writt & declaration afsd: but that he and his pledges of prosecuting to wit John Doe and Richard
Roe are in Mercy and that they the afsd: George Buchanan and William Hamilton go thereof
without day and further it is considered that the afsd: George and William Recover against the afsd

for their costs and charges by them about their defence in this part sustained to the same
George and William by the court now here according to the form of the statute in such case lately
made and provided adjudged and that the same George and William have thereof Execution &c

GH    His Lordship

   vs    Somerset To wit the Jurors for his Lordship the Right Honble the Lord

   William Kinney    propry that now is for the body of Somerset County upon their oath present
that William Kinney Late of Stepney Parish in the county afsd: planter on the XXCVII day of
December in the year of our Lord one thousand seven hundred sixty and two with force and arms
at the parish afsd: in the County afsd in and upon a certain Joseph Scroggin in the peace of
God and the said propry then and there being an assault did make and him the said Joseph
then and there did beat wound and Ill Treat so that of his Life it was much dispaired and
other harms to him the said Joseph then and there did to the great damage of the said Joseph
and against the peace of his Lordship the Right Honble the Lord propry that now is his
good Rule and Government & so Forth
Thereupon it commanded the sheriff of Somerset County that he should take the afsd: William Kinney
if he should be Found in his Bailywick and him should safe keep so that he might have his
body before his Lordships Justices at the Next Court to be held at princess Ann Town the third
tuesday of June Anno Dom. one thousand seven hundred and sixty three to answer unto his
said Lordship of and concerning the Indictment afsd: &c       Att which day here came as well

George Hayward Gent his Lordships Attorney ^ for his Said Lordship in this part prosecuteth as the afsd
William Kinney in his proper person and the said William had a hearing of the Indictment afsd:
saith that he will not contend with his Lordship but for the saveing costs trouble and Expences
about the premises submits himself at fine with his said Lordship & puts himself upon favour of the court &c
Whereupon all & Singular the premises being seen and by the court fully understood it is considered
                                         above mentioned
that the afsd; William Kinney for the offence afsd: ^ be taken &c      Which said William Kinney
present here in court as afsd: is fined for the premises & offence afsd: the sum of three pounds Current
Money of Maryland which he paid to the sheriff for the use of his Lordship &c

GH    The Same

   vs    Somerset to wit the Jurors for his Lordship the Right Honble. the Lord propry that now is

   Marcellus Hobbs    for the body of Somerset County upon their Oath present that Marcellus Hobbs Late of
Somerset parish in the county afsd: planter on the XXI day of February in the year of our Lord one
