request by the court now here of the assent of the parties afsd: adjudged which certain damages in

John Eden &NBSP;&NBSP; Command was given to the sheriffe of Somerset County that he should
vs &NBSP;&NBSP; take Charles Cottingham Late of Somerset County planter and Elinor Cotting
LD Charles Cottingham &NBSP;&NBSP; -ham his Wife if they should be found in his bailywick and them should
   et Uxor &NBSP;&NBSP; safe keep so that he might have their bodies before the Justices of his
Lordships County Court of Somerset To be held at princess Ann Town the third tuesday of March
Anno Dom: one thousand seven hundred & Sixty three to answer unto James Mills & John
Eden of a plea of trespass upon the Case &c and the same day is given to the afsd: James & John here &c
Att which day here Came the afsd: James Mills & John Eden by George Hayward their Attor-
-ney and the sheriff to wit Ephraim Wilson now here returned that he had taken the afsd:
Charles Cottingham and Elinor his Wife whose body's here at this day he had ready to answer the
afsd James Mills & John Eden of the plea afsd: as to him it was commanded And So Forth
Whereupon the afsd Charles & Elinor put in their place Littleton Dennis Gent Attorney at
Law against the afsd: James & John of the afsd: plea
And hereupon at the prayer of the parties afsd day is to them now here given untill next
Court to be held at princess Ann Town the third tuesday of June then next following in the state

that now saveing to the parties afsd            Att which day here came the ^ afd by their Attor
-neys afsd: and hereupon the afsd James Mills & John Eden complained against the afd Charles & Elinor Cottingham
in the plea afsd: in form following            Somerset fst Charles Cottingham Late of Somer
-set County planter & Elenor his Wife were attached to answer unto James Mills & John Eden of a plea
of trespass upon the Case & So Forth       And Whereupon the said James & John by George Hayward
their Atty: complain that whereas the said Elenor whilst she was Sole to wit on the fourteenth
day of May in the year of our Lord one thousand seven hundred sixty & Two at the County afsd: was
Indebted unto the said James Mills & John Eden in the sum of seven pounds Eighteen shillings &
nine pence Current Money of Maryland for the articles and things in the account hereto annexed
mentioned & so thereof Indebted being the said Elenor (whilst she was Sole in consideration
thereof afterwards to wit the same day and year afsd at the County afsd: upon herself assu-
-med and to the said James and John then & there faithfully promised that she the said Elenor
would well & faithfully pay & Satisfy to the said James & John the same Seven Pounds
Eighteen shillings & nine pence Current Money afsd: when Ever she the said Elenor Should be thereto
afterwards Required Nevertheless the same Elenor (whilst she was Sole) and the said Charles
and Elenor after the Marriage between them Celebrated not regarding the promise & assumption
                     made
of the said Elenor in form afsd ^ but Contriving & fraudulently Intending the said James & John
in this Behalf Craftily & subtilly to deceive & defraud the afsd: Sum of Seven pounds Eighteen
shillings & nine pence Current Money afd: have not paid nor hath Either of them paid (altho
often requested) but have altogether Refused and yet do refuse to pay the same to the said James
& John or any wise to Content them for the same Whereupon the said James & John Say they
are worse & have damage to the Value of Fifteen pounds Current Money of Maryland
& thereof the Bring Suit & so Forth            pledges &c J Doe & R Roe
