of the Judgement afsd: yet Remains to be made to them whereof the said John & James have besought
us to grant them their proper Remedy in this Behalf and being willing that is Just in this be
-half should be done Command you that by good and lawfull men of your bailywick you give No
-tice to the said Signey Brown that he be and appear before our Justices of our County Court of So
-merset to be held at princes Ann Town the third tuesday of March Next To shew cause if he hath or
can say anything for himself why the said John & James ought not to have Execution for the sum
of money & Tobacco afsd: against him the afsd: Signey according to the force form & effect of the recover
afsd: if he shall think fit and further to do and receive what our Same Court shall then & there consi
-der of concerning him in this behalf and have you then & there the Names of them by Whom to him
you shall give Notice and this writt wittness Sampson Wheatley Esqr one of our Justices of our
said Court the 20th day of Novr in the 12th year of our dominion &c Anno Dom. 1762 Ths Hayward J Clk
Att which day here came the afsd: John Weatherly & James Trahern by William Hayward their
Attorney and the sheriff to witt Ephraim Wilson now here returned that he by Virtue of the writt
afsd: made known unto the afsd: Signey Brown by Joseph Scroggin & John Doe good and
lawfull men of his Bailywick that he should be and appear before the Justices within mentioned
on the day and place within contained to shew cause as to him within it was commanded & So Forth
And the afsd: Signey Brown by George Hayward his Attorney comes and prays leave thereof to Imparle
here untill next Court To be held at princess Ann Town the third tuesday of June then next following
and he hath it and the same day is given to the afsd: John Weatherly & James Trahern here also &c
Att which day here came as well the afsd: John Weatherly & James Trahern as the afsd: Signey Brown
by their Attorneys afsd: and hereupon the afsd: Signey Saith that he cannot deny but that the afd. John
and James ought to have Execution against him the said Signey according to the Tenor of the
Recovery &c                 Therefore it is considered that the afsd: John and James have Execution
against the afsd Signey for the damages afsd in the scire facias afsd. mentioned according to the
force form and effect of the Recovery of the Recovery afsd &c also it is considered that the afsd:
John & James Recover against the afsd Signey
184                                          pounds of Tobacco for their costs and charges Sustained by means of
the delay of Execution of the Judgement afd and that the afsd John and James have thereof Execution &c

    Stanford    Command was given to the sheriffe of Somerset County that he

vs    should take James Caldwell Late of Somerset County planter
GH    James Caldwell    Otherwise called I James Caldwell of Somerset County if he should
be found in his bailywick and him should Safe keep so that he might have his body before the
Justices of his Lordships county court of Somerset to be held at princess Ann Town the third tuesday
of March Anno Domini one thousand seven hundred and sixty three to answer unto Elgat Hitch &
Thomas Stanford of a plea that he render unto them the sum of one hundred pounds Sterling mony
of Great Britain which to them he owes and unjustly detains and So Forth and the same day

is given to the afsd Elgat & Thomas here &c
           And hereupon the afsd Elgat & Thomas declared against the aforesaid ^ Caldwell in
                    form
the plea afsd in ^ following                 Somerset fst James Caldwell Late of Somerset County
planter otherwise called I James Caldwell of Somerset County was Summoned to answer unto Elgat
Hitch & Thos Stanford of a plea that he render unto them the sum of one hundred pounds Sterling
money of Great Britain which to them he owes and unjustly detains and So Forth
And Whereupon the said Elgit and Thomas by William Hayward their Attorney Say that whereas
