March Court 1763 213 And afterwards in the same Court Came the afd John Records in his proper person and had a hearing of the Indictment afsd Saith that he is not thereof Guilty and puts himself upon the Country & George Hayward Gent his Lordships Attorney who for his Said Lordship in this part prosecuteth in like manner Thereupon it is commanded the sheriff Of Somerset County that Immediately he should Cause To come before the Justices of his Lordships County Court of Somerset now Sitting at princess Ann Town this Instant March Twelve &c by whom &c and who &c To Recognize &c because &c And afterwards in the same Court Came as well George Hayward Gent his Lordships Attorney who for his said Lordship in this part prosecuteth as the afd John Records in his proper person & the sheriff To wit Ephraim Wilson now here returned the afsd writt of Venire Facias and the names of the Jurors in All things Served and Executed & the Jurors of that Jury thereof Impannelled being Called to wit William Skervin, John Piper, Robert Elzey, William Turpin, Elias White, Aaron Sterling, Thomas Handy, John Anderson Joshua Hitch Jonathan Tull Nehemiah Bozman William Roberts Came who to say the Truth of the premises afd being Elected Tryed and Sworn upon their oath Say that the afd John Records is not guilty of the premises in the Indictment mentioned above upon him Imposed in manner and form as the afd John Records above by pleading hath alledged Therefore it is considered that the afd John Records of and from the Indictment afsd be discharged & go thereof without Day &c
To wit at princess Ann Town in the same County the XV Day of March Anno Dom. 1763 before Sampson Wheatley Esqr and others his associates the said Lord propry his Justices of the same County Court and for the same Lord propry doth give the same Justices here to understand and be informed that Mary Jones Late of Somerset Parish in the said county of Somerset the XVI Day of January in the Year of our Lord one thousand Seven hundred Sixty and Two at the parish afd in the County afd did Commit For -nication with a certain person unknown and did permit the same unknown person to have Carnal knowledge of her body and a bastard child on the body of her the said Mary then and there did beget To the great displea -sure of Almighty God To the Evil Example of all others in such case offending contrary to the peace of the said Lord propry that now is his good Rule and Government and against The form of the act of assembly in such case made and provided and So forth And Whereupon the same Attorney of the same Lord propry for the said Lord propry prays advice of the court here in the premises & that due process Of Law in this part may be made against the said Mary to answer of and upon the premises &c Thereupon it is Commanded the sheriff of Somerset County that Immediately he should take the afd Mary Jones if she should be found in his Bailywick & her should Safe keep So that he might have her body before the Justices of his Lordships County Court of Somerset now Sitting at princess Ann Town This In -stant March To answer unto his said Lordship of & Concerning the Information afd &c And afterwards in the same Court Came the afd Mary Jones in her proper person & had a hearing of the Information afsd Saith that she Cannot deny but that she is guilty of the premises in the Informati -on afd above her Imposed in manner & form as by the Information afd above against her Suppo -sed and maketh Oath that John Tull is the Father of the child she stands informed against and is willing |
