as to the Damage of the same Robert by him by occasion of the premises in that part Sustained the same John Records Saith & acknowledgeth that the afd Robert McCra hath sustained Damages by occasion of the premises beyond his Costs and Charges by him about his Suit in that part oppo -sed To Seven pounds Curt Money & not More and because the afd Robert McCra denies not this but the ged Same allegation Grants To be True prays Judgement for those damages above acknowled^ Together with his Costs and charges to him to be adjudged &c Therefore by Consent of the parties afd it is consi -dered that the afd Robert McCra Recover against the afd John Records his Damages afd By the afd John in 199 form afd acknowledged as also pounds of Tobacco To the same Robert at his request by the court now here of the assent of the parties afd adjudged which certain Damages in the whole amount To Seven pounds Curt Money and pounds of Tobacco & the afd John in Mercy &c
-merset To be held at princess Ann Town the third tuesday of November Anno Dom. one thousand seven hundred and Sixty Two To answer unto Joseph Collins of a plea of Trespass upon the case &c & the Same day is givent To the afd Joseph Collins here also &c And Hereupon the afd Joseph complained against the afd Samuel Jackson in the plea afd in form Following Somerset fst Samuel Jackson Baily Late of Somerset County planter was attached To answer unto Joseph Collins of a plea of Trespass upon the case &c. And Whereupon the said Joseph by Litt Dennis his Atty complains that whereas the said Samuel Jackson the twentieth day of March Anno Dom. MDCCLXII at the county afd was Indebted unto the said Joseph in the sum of Thirty Seven pounds Eight shillings and three pence Sterling money of Great Brittain for so much Money by the said Joseph for the said Samuel Jackson at the Instance and request of the said Samuel Jackson paid as by the account thereof here into Court brought doth appear and So thereof Indebted being the afd Samuel Jackson in consideration thereof afterwards to wit the day and Year afd at the county afd upon himself did assume and to the said Joseph then and there faithfully promise to pay to the said Joseph the afd Sum of Money when he the said Samuel Jackson should be thereto afterwards Required and altho the said Samuel Jackson hath Since paid the afd Joseph the sum of thirty four pounds one shilling and Nine part of the afd thirty seven pounds Eight shil -lings & three pence Nevertheless the afd Samuel Jackson his promise and assumption afd in form afd made not regarding the sum of three pounds six shillings and six pence Sterling Money money afd Residue of the afd thirty seven pounds Eight shillings & three pence unto the afd Joseph he hath not paid or him for the same in any Sort Contented but the same To him to pay hath refused and still doth refuse altho the same to do afterwards to wit the day and year afd at the county afd and often since that Time by the said Joseph required to the damage of the said Joseph Ten pounds Sterling money afd & thereof he brings Suit &c
