November Court 1762 195 Remained as a devition Between the afd. Lands from the afd. time untill this present date and further this Deponant saith not Caleb Milbourn Sr Somerset county to witt The deposition of Benjamin Benston aged forty seven Years or there about deposeth and saith that about fifteen years agoe this Deponant asked Samuel Collins Junr where was the devition Between the afd. Collings an John Milborne and that the afd. Collins informed this Deponant that the Lane was the Devition and that an oak standing on a point of high Land near the marsh was a devitionall Tree between the afd. Collins and Milborne and further this Deponant saith not Beniamin Bentson This is to certify that we the subscribers after we were Quallifyed to Execute the above commission did advertise our meeting on the said Tract of Land according to the direction of an act of assembly in such case Lately made and provided as witness our hands and Seals this 21st Day of October 1762 Elias White {Seal} Teague Riggen {Seal}
well and truly to be made and done we bind Ourselves and each of us our and Each of our heirs Exrs. admrs. for the whole and in the whole Joyntly and severally firmly by these presents Sealed with our Seals and dated this 18th Day of Novr Anno Dom. 1762 The condition of the above Obligation is such that whereas the commissary General hath transmitted unto this court the account of the Estate of Joshua Edge decd wherein it is found that there is a ballance due to the abovesaid Representatives the sum of seventeen pounds fifteen shillings & seven pence half penny Curt Money thereof if the abovesaid Nehemiah Edge Dudson Bacon & Ezekiell Jones them or any of them their or any of their heirs Exrs. admrs. do and shall well and truly pay or cause to be paid to the abovesaid Representatives the afd. sum of seventeen pounds fifteen shillings & seven pence half penny Curt Money according to act of assembly and decd Will when they shall arrive at full age to re ceive the same then the above Obligation to be Void Else to Remain in full force and Vertue
county afd. in and upon a certain William Cottingham in the peace of God and the said Lord propry then and there being An assault did make and him the said William then and there did beat wound and Ill Treat so that of his Life it was much dis -paired and Other Harms to him the said William then and there did to the great Damage of the said William and against the peace of his Lordship the Right Honble the Lord propry that now is his good Rule and Government and so forth William Cottingham Jurat Ignoramus
the said Lord propry then and there being an assault did make and him the said William Roach then and there did beat wound and Ill treat so that of his Life it was much dispaired and Other harms to him the said William then and there did to the great Damage of the said William and against the peace of his Lordship the Right Honble the Lord propry that now is his good Rule and Government and so forth On the Back of the foregoing Bill of Indictment it was thus Endorsed Vizt William Roach Jurat Revill Horsey Jurat Ignoramus
twenty one Shills and three pence to be levied of your Bodyes good or Chatteles Lands or Tenements for the use of said John Mitchel in case the said John Knowles shall not pay and satisfie to the said John Mitchel the said Sum of twenty one shills and three pence So as aforesaid Recovered against him with the aditional Cost thereon on the Tenth day of Febry Next Before Mr Winder |
