November Court 1762 191 Bill obligatory which the said Rencher sealed with the seal of the said John here in Court shews whose date is the day and year afd. did oblidge himself to pay unto the said Rencher the afd. sum of six pounds fifteen shillings and three pence Current money to be paid to the said Rencher when he the said John should be thereto afterwards re quired Nevertheless the said John altho often required the afd. sum of money unto the said Rencher he hath not rendered but the same to him to render hath denyed and still doth deny and unjustly detain to the damage of the said Rencher ten pounds current money and thereof he brings Suit &c J Doe pledges of pros R Roe And the afd. John Records by his Attorneys afd. comes and defends the force and injury when &c and prays leave thereof to Imparle here until next court to be held at princess Ann Town the third tuesday of March then next following and he hath it and the same day is given to the afd. Rencher here also &c Att which day here came the parties afd. by their Attorneys afd. and hereupon the afd. John Records prays further Leave thereof to Imparle here until next court to be held at princes Ann Town the third tues day of June then next following & he hath it and the same day is given to the afd. Rencher here also &c Att which day here came as well the afd. Rencher Roberts as the afd. John Records by their Attorneys afd. and hereupon the afd. John prays further leave thereof to Imparle here until next court to be held at princess Ann Town the third tuesday of August then next following & he hath it & the same day is given to the afd. John Records prays further thereof to Imparle here until next court to be held at princess Ann Town the third tuesday of November then next following & he hath it & the same day is given to the afd. John as before defends the force and injury when &c and says that he did not assume upon himself in manner and form as the said Rencher above complains against him and of this he puts himself upon the country &c And the said John by leave of the court here and according to the form of the statute in that case made and provided further comes & Defends the force and injury when &c and says that the said Rencher his action afd. against him to have and maintain ought not because he says that cause of action did not accrue to the said Rencher at any time within three years next before the day of the obtaining the original writt of him the said Rencher and this he is ready to verify wherefore he prays Judgement if the afd. Rencher his action afd. against him to have ought &c And hereupon the said Rencher Roberts then and there his writ and Decl. afd. against the afd. John Records did not prosecute with effect but voluntarily suffered his suit to be discontinued Therefore it is considered by the court here that the afd. Rencher Roberts take nothing by his writt and Declaration afd. but that he and his pledges of prosecuting to witt John Doe and Richard Roe are in mercy and and that the afd. John Records go thereof without day and further it is considered that the afd. John Records recover against the afd. Rencher Roberts pounds of Tobacco for his costs and charges by him about his 705 1/2 defence in this part sustained to the same John Records by the court now here according to the form of the statute in such case Lately made and provided adjudged and that the same John have thereof Execution &c
-cess Ann Town the third tuesday of August Anno Domini one thousand seven hundred sixty and one to answer unto Samuel Miles of a plea that he render unto him one negro man slave called Cesar of the Value of one hundred pounds cur -rent money of Maryland which from him he unjustly detains and so forth and the same day is given to the afd. Samuel here &c Att which day here came the afd. Samuel Miles by William Hayward his Attorney And the sheriff to witt John Dennis now here returned that he had taken the afd. Daniel Cullen whose body here at this day he had ready to answer the afd. Daniel Cullen of the afd. plea as to him it was commanded And hereupon the afd. Daniel Cullen puts in his place Samuel Wilson Gent Attorney against the afd. Samuel Miles of the afd. plea And hereupon at the prayer of the parties afd. Day is to them now here given until next court to be held at princess Ann Town the third tuesday of November then next following in the state that now saveing to the parties afd. Att which day here came the parties afd. by their Attorneys afd. And hereupon the afd. Samuel declared aga inst the afd. Daniel Cullen in the plea afd. in form following Somerset fst Daniel Cullen Late of somerset county ship Carpenter was summoned to answer unto Samuel Miles of a plea that he render unto him one negro man slave called Cesar of the Value of one hundred pounds Curt Money of Maryland which from him he unjustly detains and so forth And |
