Douglas denies not this but the same Allegation grants to be true prays Judgement for these damages
above acknowledged together with his costs & charges to him to be adjudged &c         Therefore by con
-sent of the parties afd. it is considered that the afd. Thomas Douglas recover against the afd. Nathaniel Whi

taker his Damages ^ afd. fourteen pounds seventeen shillings and five pence by the afd. Nathaniel Whitaker in form
256    afd. acknowledged as also                                  pounds of Tobacco for his costs and charges afd. To the same Tho
-mas Douglas at his request by the court now here of the assent of the parties afd. adjudged which certain da
-mages in the whole amount to fourteen pounds seventeen shillings and five pence Curt Money and

@    Command was given unto the sheriff of somerset county that he should take Nathaniel Whi
LD SW    The same    taker Late of somerset county Clerk if he should be found in his Bailywick and him should
-d safe keep so that he might have his body before the Justices of his Lordships county court of somerset to be held
at princess Ann Town the third tuesday of August Anno Dom. one thousand seven hundred & sixty two to answer
unto Thomas Wilson of a plea of trespass upon the case and so forth and the same day is given to the afd. Thomas
here &c              And hereupon the afd. Thomas Wilson complained against the afd. Nathaniel
Whitaker in the plea afd. in form following               Somerset fst Nathaniel Whitaker Late of somer
-set county Clerk was attached to answer unto Thomas Wilson of a plea of trespass upon the case & so forth
And Whereupon the said Thomas by George Hayward his Attorney complains that whereas the said Nathaniel on
the seventh day of September in the Year of our Lord one thousand seven hundred sixty and one at somerset coun
-ty afd. was Indebted unto the said Thomas in the sum of nine pounds & five shillings current money of mary
-land for the Articles and things in the account hereto annexed mentioned and so thereof Indebted being the said Na
-thaniel in consideration thereof afterwards to wit the same day and year afsd. at the county afsd. upon himself
assumed and to the said Thomas then and there faithfully promised that he the said Nathaniel the sum of money
afd. when he should be thereto afterwards required unto the said well and faithfully would pay and content
Nevertheless the said Nathaniel his promise & assumption afsd. in form afd. made little Regarding but minding and
fraudulently Intending the said Thomas in this particular craftily and subtilly to deceive and defraud the sum of

money
