Att which day here as well the afd. Alexander Stuart as the afd. John Records by their Attorneys afd. and
hereupon the said John prays further leave thereof to Imparle here untill next court to be held at
princess Ann Town the third tuesday of August then next following and he hath it and the same day
is given to the afd. Alexander here also &c            Att which day here came as well the afd. Alex
-ander Stuart as the afd. John Records by their Attorneys afd. And hereupon the said John Records as be
-fore defends the force and injury when &c and says the did not assume upon himself in manner and form
as the said Alexander above against him hath complained and of this he puts himself upon the coun
-try and so forth and the plaintiff Likewise            Thereupon it is commanded the sheriff of som
erset County that he should cause to come before the Justices of his Lordships County court of somerset at
at the Next Court to be held at princess Ann Town the third tuesday of Novr then next following
Twelve &c by whom &c and who neither &c to Recognize &c because as well &c And the same day
is given to the afd. parties here &c.
           Att which day here Came as well the afd. Alexander Stuart as the afd. John Records by their
Attorneys afd. And the Sheriff to witt Ephraim Wilson now here Returned the afd. Writt of Veniry Facias and
the Names of the Jurors in all things Served and Executed and the Jurors of that Jury thereof Impannelled
being Called Some of them to witt William Fleming, William Venables, John Pollit, Southy Whittington
William Fountain, Isaiah Tilman, John Anderson and Jessey King Came and were Sworn upon that Jury
and because the Residue of the Jurors of that Same Jury did not Appear therefore others of the by
Standers by the Sheriff of the County afd. hereunto Elected and at the Request of the afd. Alexander
Stuart and by the Command of the afd. Justices are newly put on whose names to the pannell within
Written are filed According to the form of the Statute in Such Case provided which Said Jurors so
newly put on to witt    William Skervin, Ezekiell Hall Randall Long and Thomas Marshall being
Called Likewise Came who to Say the truth of the premisses afd. together with the Other Jurors afd.
before Impannelled and Sworn being Elected tryed and Sworn upon their Oath Say that the afd. John
Records did Assume upon himself in Manner and form as the afd. Alexr. Above Against him hath
Complained and Assessed the Damages of the Same Alexander by Occasion of the nonperformance of
the Promise and Assumption afd. beyond his Costs and Charges by him about his Suit in that part
Apposed to Thirty Six Pounds Eight Shillings and Two pence half penny Curt Money of Maryland and
for those Costs and Charges to One pound of tobacco
           Therefore it is Considered that the afd. Alexander Stuart Recover Against the afd.
John Records his Damages afd. by the Jurors afd. in form afd. Assessed as also
604                        Pounds of Tobacco for his Costs and Charges afd. to the Same Alexander by the
Court here of his Assent of Increase Adjudged which Certain Damages in the Whole Amount to thirty
Six pound Eight Shillings and Two pence half penny Curt Money of Maryland and

LD    Richard Nicholson    Command was given unto the sheriff of somerset county that he should
take Richard Nicholson Late of somerset county planter if he should be found in his Bailywick and
should safe keep so that he might have his body before the justices of his Lordships county court of somer
-set to be held at princess Ann Town the third tuesday of August Anno Dom. One thousand seven hun
-dred and sixty one to answer unto John Talbot of a plea of trespass upon the case and so fort and the
same day is given to the afd. John here &c.            Att which Day here came the afd. John Talbot by
George Hayward his Attorney and the sheriff to witt John Dennis now here returned that he had taken
the afd. Richard Nicholson whose body here at this day he had ready to answer the afd. John Talbot
