November Court 1762 186 Court to be held at princess Ann Town the third tuesday of November then next following in the state that now saveing to the parties afd. &c Att which day here came the parties afd. by their Attor -neys afd. and hereupon the said Alexander complained against the afd. John in the plea afd. in form follo -wing Somerset to wit John Records Late of somerset county planter was attached to answer unto Alexander Stuart of a plea of trespass upon the case and so forth and And Whereupon the said Alexander by Josiah Polk his Attorney complains that whereas the said John on the twentyeth Day of May Anno Dom. one thousand seven hundred and sixty one at the county afd. was Indebted unto the said Alex ander in the sum of thirty six pounds Eight shillings and two pence half penny current money of Maryland for the articles in the account hereto annexed mentioned and so thereof Indebted being the said John in consideration thereof afterwards to wit the day and Year afd. at the county afd. upon himself did assume and to the said Alexander then and there faithfully promised that he the said John when he should be thereto afterwards required unto the said Alexander he would faithfully pay and content Nevertheless the said John his promise and assumption afd. in form afd. made not regarding the afd. sum of thirty six pounds Eight shillings and two pence half penny current money afd. to the afd. Alexander he hath not paid nor him for the same in any sort contented but that to do altogether hath refu -sed and still doth refuse altho the same to do afterwards to wit the day and Year afd. at the county afd. and often since that time by the said Alexander required to the damage of the said Alexander sixty pounds Current money of Maryland and thereof he brings suit &c J Doe, R Roe pledges of prosecuting
for the county afd. And made Oath on the holy Evengelis that the above account is Just and true and that he hath recd no part parcell satisfaction or surety For the same Except James Finch his assump -tion 6th June 1761 Isaac Handy And the afd. John Records by his attorney afd. Comes & Defends the force and Injury where &c and prays leave thereof to imparle here untill next court to be held at princess Ann Town the third tuesday of March then next following and he hath it and the same day is given to the afd. Alexander here also &c Att which day here came as well the afd. Alexander Stuart as the afd. John Records by their Attorneys afd. and hereupon the said John prays further Leave thereof to Imparle here untill next court to it be held at princess Ann Town the third tuesday of June then next following and he hath ^ and the same day is given to the afd.
