August Court 1762 166 fourteen Shillings and Eleven pence Curt Money and not More and because the afd. Alexr. denys not this but the Same Allegation Grants to be true prays Judgment for those damages Above Acknowledged together with his Costs and Charges afd. to him to be Adjudged &c. Therefore by Consent of the parties afd. that the afd. Alexander Stuart Recover Against the afd. Natl. Waller his Damages afd. to the afd. Two pound fourteen Shillings and Eleven pence Curt Money by the Same Natl in form afd. Acknowledged as 198 1/2 Also Pounds of tobacco for his Costs and Charges afd. to the Same Alexander at his Request by the Court now here of the Assent of the parties afd. Adjudged which Certain Damages in the Whole Amount to Two pound fourteen Shillings and Eleven pence Curt Money and Pounds of tobacco and the afd. Natl in Mercy &c
to be held at Princes Ann Town the third Tuesday of June Anno Dom. one thousand Seven hundred and Sixty Two to Answer unto Michael Taylor of A plea of trespass upon the Case &c. And the Same day is Given to the afd. Michael here &c Att which day here Came the afd. Michael Taylor by Saml Wilson his Attorney And the Sheriff to witt Ephraim Wilson now here Returned that he had taken the afd. Brittan Powell whose body here at this day he had Ready to Answer the afd. Michael Taylor of the afd. plea as to him it was Commanded Whereupon the Said Brittan Powell put in his place William Hayward Gent Attorney at Law Against the afd. Michael Taylor of the afd. plea And thereupon at the prayer of the parties afd. day is to them now here Given untill next Court to be held at Princes Ann Town the third Tuesday of August then next following in the State that now Saveing to the Parties afd. &c Att which day here Came the parties afd. by their Attorneys afd. And hereupon the Said Michael Complained Against the afd. Brittan in the plea afd. in form following Somerset fst Brittan Powell Late of Somerset County Planter was Attached to Answer unto Michael Taylor of A plea of trespass upon the Case &c And Whereupon the Said Michael Taylor by Sal Wilson his Atty Complains that Whereas the Said Britain on the Sixteenth day of Febry in the Year of our Lord God Seventeen hundred and Sixty Two at the County afd. was Indebted unto him the Said Michael in the Sum of Twenty Nine pounds Seven Shillings and four pence half penny Curt Money of Maryland for the Severall Matters and things in the Account hereto Annexed Mentioned and Specified and So thereof indebted being in Consideration thereof Afterwards to wit the day and Year afd. at the County afd. upon himself did Assume and to the Said Michael then and there faithfully promise that he the Said Brittan the Said Sum of Money to the Said Michael When afterwards he Should be thereto Required Well and faithfully pay and Content Yet the Said Brittan his Promise and Assumption afd. So as afd. Made not Regarding but plotting and fraudulently intending him the Said Michael in that part Craftily to deceive and defraud the Sum of Money to the Said Michael hath not paid or him for the Same in Any Sort hitherto Contented but the Same to him to pay hitherto hath Refused and Still doth Refuse Altho thereto Afterwards to wit the day and Year afd. at the County afd. and often Since by the Said Michael Required to the Damage of the Said Michael in the Sum of forty pounds Curt Money of Maryland and therefore he brings Suit &c. Pledges &c. J: Doe & R: Roe
