                  August Court                           1762                      164
not paid but that to do Altogether hath Refused and Still doth Refuse altho the Same to do Afterwards to wit the fifth
day of Febry Anno Dom. MDCCLV at the County afd. and often Since that time by the Said Samuel Required to the damage
of the Said Samuel thirty Pounds Curt Money of and thereof he brings Suit &c              Pledges &c. J: Doe & R: Roe
      And the afd. John Records by his Attorney afd. Comes and defends the force and Injury when &c And prays Leave
thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of August then next following
and he hath it and the Same day is Given to the afd. Samuel here also &c
             Att which day here Came as well the afd. Samuel Shepard as the afd. John Records by
their Attorneys afd. And hereupon the Said John as before defends the force and Injury when &c. And Saith
that he Cannot deny the Action afd. of the afd. Samuel Shepard nor but that he did Assume upon himself in Manner and form
as the afd. Samuel Above Against him hath Complained and as to the damage of the Same Samuel by him by Occasion
of the Premisses in that part Sustained the Same John Saith and Acknowledgeth that the afd. Samuel hath
Sustained Damages by Occasion of the Premisses beyond his Costs and Charges by him About his Suit in that part
Apposed to Twenty Two pounds fourteen Shillings and five pence Curt Money and not More and because the afd.
Samuel denys not this but the Same Allegation Grants to be true prays Judgment for those Damages above Acknow:
:ledged together with his Costs and Charges afd. to him to be Adjudged
             Therefore by Consent of the parties afd. it is Considered that the afd. Samuel Shepard
Recover Against the afd. John Records his Damages afd. to the afd. Twenty Two pounds fourteen Shillings and five
288 1/2    pence Curt Money by the Same John in form afd. Acknowledged as also
Pounds of Tobacco for his Costs and Charges afd. to the Same Samuel at his Request by the Court now here of the Assent
of the Parties afd. Adjudged which Certain Damages in the Whole Amount to Twenty Two pounds fourteen
Shillings and five pence Curt Money and                                                    Pounds of Tobacco and the afd.

@    Command was given to the Sheriff of Somerset County that he Should Take William
SW    Wm. Outerbridge    Outerbridge Late of Somerset County Planter if he Should be found in his Bailywick and him
Should Safe keep so that he might Have his body before the Justices of his Lordships County Court of Somerset to be
held at Princes Ann Town the third Tuesday of March Anno Dom. 1762 to Answer unto James Houston of A plea of
trespass upon the Case &c. And the Same day is Given to the afd. James here &c
             Att which day here Came the afd. James Houston by George Hayward his Attorney and the
Sheriff to witt Ephraim Wilson now here Returned that he had taken the afd. William Outerbridge whose body here
at this day he had Ready to Answer the afd. James Houston of the afd. plea as to him it was Commanded
             Whereupon the Said Wm. Outerbridge at the prayer of the afd. James Houston is Adjudged to
Give Special Bail to the Action afd. Thereupon a Certain Ephraim King of Somerset County Gent present
here in Court in his Proper Person undertook for the Said William Outerbridge and Assumed upon himself
that if it Should happen that Judgment in the plea afd. Should be Rendred for the Said James Houston Against
the afd. William Outerbridge or that he the Said William Outerbridge Should be therein COnvict that then
he the Said William Outerbridge Should pay and Satisfie unto the afd. James Houston the Judgment
of the Court thereupon or Render his body in Execution of Such Judgment to the prison of the Sheriff of
the County afd. in Satisfaction thereof or that he the Said Eph. King will do the Same for him &c
           Whereupon the Said Wm. Outerbridge puts in his place Saml. Wilson Gent Attorney at Law against
the afd. James of the afd. plea       And thereupon at the prayer of the parties afd. day is to them now here given
untill next Court to be held at Princes Ann Town the third Tuesday of June then next following in the State
that now Saveing to the parties afd.    Att which day here Came the parties afd. by their Attorneys afd. And hereupon
Ephraim King Special Bail of the afd. William Outerbridge Came here into Court in his proper person And prays that
for his Indemnity he may be discharged of And from his Manucaption And the Bail piece Entred into for the Said William
Whereupon the Said Ephraim King of his Manucaption and bail piece afd. is discharged And the Said William
Outerbridge is Committed into the Custody of the Sheriff of the County afd. there to Remain &c. And hereupon the Said
James Houston Complained Against the afd. William Outerbridge in the plea afd. in form following
