August Court 1762 164 keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at Princes Ann Town the third Tuesday of March Anno Dom. one thousand Seven hundred and Sixty Two to Answer unto Samuel Shepherd of A plea of trespass upon the Case and So forth And the Same day is given to the afd. Saml. here &c. Att which day here Came the afd. Samuel Shepherd by Josiah Polk his Attorney and the Sheriff to witt Ephraim Wilson now here Returned that he had taken the afd. John Records whose body here at this day he had Ready to Answer the afd. Samuel Shepherd of the afd. plea as to him it was Commanded Whereupon the Said John Records at the prayer of the afd. Samuel Shepherd Adjudged to give Special Bail to the Action afd. Thereupon a Certain Richard Waller and Lazarus Hoffington of Somerset County planter present here in Court in his proper person undertook and Each of them undertook for the Said John Records And Assumed upon themselves that if it Should happen that Judgment in the plea afd. Should be Rendred for the Said Samuel Shepherd Against the afd. John Records or that he the Said John Records Should be therein Convict that then he the Said John Records Should pay and Satisfie unto the afd. Samuel Shepherd the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the prison of the Sheriff of the County afd. in Satisfaction thereof or that they the Said Richard and Each of them Waller and Lazarus Hoffington ^ will do the Same for him &c Whereupon the Said John Records puts in his place Saml. Wilson Gent Attorney at Law Against the afd. Samuel Shepherd of the afd. plea And thereupon at the prayer of the parties afd. day is to them now here Given untill next Court to be held at Princes Ann Town the third Tuesday of June then next following in the State that now Saveing to the Parties afd. &c Att which day here Came the parties afd. by their Attorneys afd. & hereupon the Said Samuel Complained Against the afd. John in the plea afd. in form following Somerset to wit John Records Jur. Late of Somerset County Planter was Attached to Answer unto Samuel Sheperd of A plea of trespass upon the Case &c. And Whereupon the Said Samuel by Josiah Polk his Attorney Complains that Whereas the Said John on the fourth day of June Anno Dom. MDCCLIV at Somerset County afd. did make his Certain Note in Writing Called a Promissary Note with his proper hand thereto Subscribed bearing date the day and Year afd. at the County afd. and that Note to the Said Samuel then and there did deliver by which note the Said John Promised to pay to the Said Samuel Sheperd or his Order the Just and full Sum of Seven pounds ninteen Shillings and three pence Curt Lawfull Money of Maryland to be paid at or before the fifth day of Febry next Ensuing the date of the Said note with Lawfull Interest from the date of the Said note for Value Recd. by Means whereof and by force of the Statute in Such Case made and provided the Said John became Chargeable to pay to the Said Samuel the Said Sum in the Said Note Mentioned together with Legal Interest thereon According to the tenor of that note and So thereof Chargeable being the Said John in Consideration thereof Last Afterwards to wit the day and Year ^ afd. at the County afd. Promised to pay to the Said Samuel the Said Sum in the Said Note Mentioned with Legal Interest thereon According to the tenor of that note Whereas also the Said John on the fourth day of June Anno Dom. MDCCLIV at Somerset County afd. did Make his Certain Other Note in Writing Called A promissary Note with his proper hand thereto Subscribed bearing date the day and Year afd. at the County afd. and that note to the Said Samuel then and there did deliver by Which Note the Said John Promised to pay to Samuel Sheperd or Order the Just and full Sum of Seven pound Ninteen Shillings to be paid at or before the fourth day of Febry Next Ensuing the date of the said Note Last Mentioned and with Legall Interest from the fourth day of Febry Next in the Year one thousand Seven hundred and fifty five for Value Received by Means whereof and by force of the Statute in Such Case Made and Provided the Said John became Chargeable to pay to the Said Samuel the Said Sum in the Said note Last Mentioned with Interest thereon According to the tenor of that note and So thereof Chargeable being the Said John in Consideration thereof Afterwards to wit the day and Year Last afd. at the County afd. Promised to pay to the Said Samuel the Said Sum in the Said Note Last Mentioned with the Interest thereon According to the tenor of that Note Nevertheless the Said John his Severall Promises afd. in form afd. Made not Regarding the Severall Sums of Money afd. in the afd. Notes Mentioned together with the Sums of Interest Severally due thereon According to the tenor of the Said Notes to the Said Samuel he hath not |
