August Court 1762 157 Wilson his Attorney and the Sheriff to witt Ephraim Wilson Returned the afd. Writt of Attachment Endorsed in Manner following Vizt By Virtue of the within Writt to me directed I have Severally Levied in the hands of Mr George Swope and Mr. Mary Waggaman to the Amount of the within Sum of Money and Tobacco and by John Doe and Richd. Roe Good and Lawfull men of My Bailywick I Severally made known to the Said Swope and Waggaman that they Severally be before Your Worships at the time in the Said Writt Mentioned for the purposes in the Same Mentioned So Answers Ephm. Wilson Sher Whereupon the Said William Knowls Altho Solemnly Called Came not but makes default &c Whereupon the Said George Swope and Mary Waggaman Garnishees of the afd. William Knowles in their Proper Persons Came and the Said George Swope Says that he Cannot deny but that he has of the Rights & Credits of the Said William Knowles to the Value of Two pound Nineteen Shillings and four pence Curt Money And not more nor Can he Say but that the Said Money So as afd. Confessed Ought to be Condemned in his hands for the use of the Said Levin Ballard as of the Rights &c Credits of the Said William Knowles which the Said Levin doth not Gainsay Likewise the Said Mary Waggaman Says that She Cannot deny but that She has of the Goods and Chattles of the Said William Knowles as follows Vizt One Loom, Two flayed Chairs One old Bed Bedsted and boulster, one Old Blanket, One Old Sheet, one Linnen Wheel, 2 pr. old Short Breeches One Iron Pott, Two pewter Spoons, Seven Wooden Trenchers & One Chest and not more nor Can She Say but that the Sundry Goods and Chattles afd. Ought to be Condemned in her hands for the use of the Said Levin Ballard as of the Rights of the Said Wm. Knowles which the Said Levin doth not Gainsay Whereupon the Said Levin Ballard present here in Court in his proper person prays that the afd. Goods and Chattles so as afd. Confessed by the afd. Mary Waggaman may be Valued by the Court here in Current Money of Maryland &c. Thereupon the Court here Valued the Sundry Goods and Chattles so as afd. Confessed by the afd. Mary Waggaman Garnishe afd. to be Worth three pound three Shillings and Nine pence Curt Money And Not More Thereupon the Said Levin Ballard prays that upon his Giving Security According to Act of Ninteen in Assembly in Such Case provided the afd. Two pounds of George Swope Gar as afd. and the Sundry Goods and Chattles So as afd. Confessed by Mary Waggaman of the Value afd. be Condemned in the hands of the afd. Swope and Waggaman as of the Rights & Credits of the afd. Wm. Knowls towards Satsifieing unto him the Said Levin his Damages and all Costs and Charges Accrewing by Means of the Attachment afd. Whereupon a Certain Samuel Wilson of Somerset County Gent present herein Court in his proper Person undertook for the Said Levin Ballard According to Act of Assembly that in Case the Said William Knowles do at any time within a year and a day Appear and Make all or Any part of the Said Levin Ballards Claim Against him Appear to be Satisfied or Otherwise to have been undue before the Laying of this Attachment that then the Said Levin Ballard Shall Make Restitution unto him the Said William Knowles of all Such part thereof as Shall be made Appear to be undue &c. or that he the Said Samuel Wilson will do the Same for him &c Therefore it is Considered that the Sum of Two pound Nineteen Shillings and four pence Curt Money so afd. Confessed by the afd. George Swope be Condemned in the hands of the Said George as of the Rights & Credits of the Said William towards Satisfying unto the Said Levin his Damages and all Costs and Charges Accrewing by means of the Attachment afd. and that the Said Levin have thereof Execution &c. Also it is Considered that the afd. Goods and Chattles so as afd. Confessed by the afd. Mary Waggaman of the Value of three pounds three Shillings and Nine pence Curt Money be Condemned in the hands of the Said Mary as of the Rights and Credits of the Said William towards Satisfying unto the Said Levin his damages and all Costs and Charges Accrewing by Means of the Attachment afd. and that the Said Levin have thereof Execution &c
Somerset to be held at Princes Ann Town the third Tuesday of March Anno Dom. One thousand Seven hundred And Sixty to Answer unto William Figgs of A plea of trespass upon the Case &c. And the Same day is given to the afd. Wm. here &c. |
