March Court 1762 125 the County afd. was Indebted unto the Said Alexander in the Sum of Eighteen pounds fourteen Shillings and five pence Curt Money of Maryland for the Articles in the Account hereto Annexed mentioned and So thereof Indebted being the Said John on Consideration thereof Afterwards to wit the day and Year afd. at the County afd. upon himself did Assume and to the Said Alexander then and there faithfully promise that he the Said John when he Should be there to afterwards Required unto the Said Alexander he would faithfully pay and Content Nevertheless the Said John his Promise and Assumption afd. in form afd. made not Regarding the afd. Sum of Eighteen pounds fourteen Shillings and five pence Curt Money afd. to the afd. Alexander he hath not paid nor him for the Same in Any Sort Contented but that to do hath Refused and Still doth Refuse Altho the Same to do Afterwards to witt the day and Year afd. at the County afd. and often Afterwards by the Said Alexander Required to the Damage of the Said Alexander thirty Six pounds Curt Money of Maryland and thereof he brings Suit & So forth Pledges &c. J Joe & R: Roe
About his Suit in that part Apposed to Eleven pounds fourteen Shillings and not More and because the afd. Alexr. denys not this but the Same Allegation Grants to be true prays Judgment for those damages above Acknowledged together with his Costs and Charges afd. to him to be Adjudged Therefore by Consent of the parties afd. it is Considered that the afd. Alexander Stuart Recover Against the afd. John Weatherly his Damages afd. to the afd. Eleven pounds fourteen Shillings Curt Money by the Same John in form afd. Acknowledged as also Pounds of Tobacco for his Costs and Charges afd. to the Same Alexander at his Request by the Court now here of the Assent of the parties afd. adjudged which Certain Damages in the Whole Amount to Eleven pound fourteen Shillings Curt Money and 216 Pounds of Tobacco and the afd. John in Mercy &c with Stay of Execution untill the Tenth day of Aprill next &c
Seven hundred and Sixty One to Answer unto Henry Lowes Jur. and Edward Waters Jur. Executors of the Last will and Testament of Tubman Lowes decd. of A plea that he Render them the Sum of Eight pounds Curt Money of Maryland which from them he unjustly detains and So forth And the Same day is Given to the afd. Henry & Edward here &c And hereupon the Said Henry and Edward declared Against the afd. Hope in the plea afd. in form following Somerset |
