November Court 1761 116 Just hath Removed or is About to Remove his Effects in order to defraud his ^ Creditors These are therefore in his Lordships name to Authorize you to Issue an Attachment for the Said John Gale and John Ponsonby Against the Goods Chattles Rights and Credits of the Said Henry Calkwell for the afd. Sum of Eleven pounds ten Shillings & a penny one farthing Curt Money with the Incident Costs thereon and this Shall be your Warrant Given under my hand and Seal the 17th day of October in the Year of our Lord One thousand Seven hundred and Sixty One To Mr Thos. Hayward Clk. of Somt County Joseph Gilliss By Virtue of the above Warrant and Accounts proven was Issued the following Attachment Somerset fst Frederick Absolute Lord and Propry of the Provinces of Maryland and Avalon Lord Baron of Baltemore &c. To the Sheriff of Somerset County Greeting we Command You that you Attach Any the Goods Chattles and Credits of Henry Calkwell Late of Somerset County Breeches maker if they Shall be found in Your Bailywick to the Value of Eleven pounds ten Shillings and a penny farthing Curt Money and Eight hundred pounds of Tobacco And When you have the Same Attached or Any part thereof the Same in Your Custody Safe keep so that you have the Same before our Justices of our County Court of Somerset to be held at Princes Ann Town the third Tuesday of November next then and there to be Condemned According to Act of Assembly to and for the use of a Certain John Gale and John Ponsonby unless the Said Henry Calkwell by himself or his Atty Shall Appear and Answer unto the Said John Gale and John Ponsonby in a plea of trespass upon the Case &c. According to Law and that by Good and Lawfull men of Your Bailywick you make known unto the person or persons in Whose hands you make the Same Attachment that he She or they be and Appear before our Justices of our County Court of Somerset to be held as afd. to Shew Cause if Any he She or they have why the Same Goods Chattles and Credits So Attached in his her or their hands Ought not to be Condemned and Execution thereof had and made According to Act of Assembly in Such Case made and provided if to him her or them it Shall Seem meet and how you Shall Execute this Writt that you make known unto our Said Justices at the day and place afd. And have you then and there this Writt Wittness Isaac Handy Esqr. one of our Justices or our Said Court the 20th day of August Anno Dom. 1761 Att which Said third Tuesday of November Came the afd. John Gale & John Ponsonby by Wm. Hayward their Attorney and the Sheriff to witt John Dennis Gent now here Returned the afd. Writt of Attachment Indorsed in Manner following with a Schedule thereto Annexed Somerset to wit I hereby Certifie to the Justices within Named that I have Attached of the Goods and Chattles of the within Henry Calkwell the Sum of Six pounds Eleven Shillings and Nine pence Curt Money as by the Shedule hereto Annexed towards Satisfying the within Gale and Ponsonby their Debt within Mentioned So Answers J Dennis Sher. Robert Leatherbury, Thos. Sloss, Wm. McClemey and Alexander Roberson Appraisers for John Gale and John Ponsonby
Thereupon the Said Gale and Ponsonby by their Attorney afd. Come and pray According to Act of Assembly in Such Case made and Provided the Severall Goods and Chattles so as afd. Attached and Valued at Six Pound Eleven Shillings and Nine pence as Appears by the Appraisment afd. May be Condemned as of the Goods and Chattles of the afd. Henry Calkwell towards Satisfying unto them the Said Gale and Ponsonby their Damages and all Costs and Charges Accrewing by means of the Attachment afd. Thereupon a Certain Littleton Dennis John Gale & John Ponsonby According to Act of Assembly that if the Said Henry Calkwell do at any time within a Year and a day Appear and make all or Any part of the Said Gale and Ponsonbys Claim Against him Appear to be Satisfied or Otherwise to have been undue before the Laying of this Attachment that then they the Said Gale & Ponsonby Shall Make Restitution to him the Said Henry Calkwell of all or Such part thereof as Shall be made Appear to be undue or that he the Said Littleton Dennis will do the Same for them &c Therefore it is Considered that the Severall Goods and Chattles So as afd. Attached and Valued at Six pounds |
