August Court 1761 106 James Otley declared he Asked Simon Smith what that White Oak was Marked for and Simon Smith told him it was the first bounder of a tract of Land Called Gleneath and this deponant further Saith not The above is a true deposition taken by us the Subscribers for E: White deft. Waters Somerset County fst The Deposition of Caleb Milbourn Aged fifty four Years or there abouts being Sworn on the hold Evangelis of Almighty God deposeth as followeth (to witt) that John Cliffen told him this deponant that John Milbourn and Samuel Collins did Sware Very Right when they were Sworn by Majr. Sampson Wheatly and Capn. David Wilson and Capn. Samuel Wilson to Where a Cedar Post had Stood on the Sown Side where there is now a Slipe Possimon tree and this Deponant Saith he made Answer and Said he believed they did Sware Right for this Deponant Saith he and Capn. William Holland did See Some Line trees from where it was Said the Cedar post Stood And the Said John Cliffen told him this deponant the Line of Marked trees went Quite a Cross the neck and Said there was an Oak on the afd. Line that Robert Boyer made a Certain Cornelius Butler Cut it down and Maul it in firewood and this deponant Saith he ASked the Said Cliffen what Went with Cedar Post and he Said that Robert Boyer Pulled it up and threw it in the Bay and Likewise this Deponant Asked the Said Cliffen What that Cedar Post was fixed there for and he Said that his Mother told him that it was Set down where a Bounder of Whites Land Stood that was dead and this Deponant further Saith not Calib Milbourn the Above is a true Deposition taken by us the Subscribers for E: White deft. Waters Somerset County fst The Deposition of John Milbourn Aged fifty Six Years or there abouts being Sworn on the holy Evangelis of Almighty God deposeth as followeth (to witt) Saith that he Saw a Marked White Oak Standing near the Sown Side and near the Mouth of a Small Drean near to a Small Slipe Pine which is a Small Distance Easterly from Elias White fence which is Partly made with Whole Cuts of timber Commonly Called and known by the name of the Water Work and Capn. William Holland told this Deponant it was a bounder Between Wm. White and Howard and further this Deponant Declareth that further Down the Sown or Bay Side on the back of the high Land near to where there is Now a Slipe Possimon tree he Saw a Cedar Post Marked with Sixteen Notches and Saith he was told by Jacob Adams and Joshua Milbourn that it was a bounder between the Point Land and Michael Cliffen Land and this Deponant further Saith not John Milbourn The above is a true Deposition taken by us the Subscribers for E: White deft. Waters Somerset County fst The Deposition of John Riggen Aged fifty four years or there abouts being Sworn on the holy Evangelis of Almighty God Deposeth as followeth (to wit) that as near as this Deponant Can Remember the time About Eighteen or Nineteen Years Past he this Deponant Saith he Can Remember that when there was an Arbitration Between John Williams and Robert Boyer in Relation to the title of their Lands and James Otley was then Sworn to What he knew in Relation to the bounds of a tract of Land Called Gleneath And the Said James Otley declared that Simon Smith Shewed him a White Oak with Sixteen Notches Standing on the End of Point which this deponant Saith he has always known it Called by the name of Spensicks Point or Possimon Point and this Deponant Saith he always Allowed the afd. Point to be at the Mouth of the Narrows and further this Deponant Saith not the above is a true Deposition taken by us the Subscribers John Riggen Jno. Broughton Edwd. Waters Somerset County fst The Deposition of John Evans Aged fifty three Years or there abouts being Sworn on the holy Evangelist of Almighty God Deposeth as followeth to wit that near the Mouth of a Small Drean and near to where there is now a Small Slipe Pine which is a Small Distance Easterly from Elias White fence which is partly made with Whole Cuts of Timber Commonly Called and know by the Name of the Water Work there is now the Roots of a Stump which Appears Very plane and this Deponant Saith that he heard John White Say it was a bounder of his Point Land and this deponant Saith that John White and his Mother never Claimed no Lower Down the Sown then the aforementioned Stump and this Deponant further Saith not the above is a true deposition taken by us the Subscribers Jno.
