CHAP. 156.

all the right, title, claim and interest of, in, and
to the said
real estate, which the said Mary Milliway had at the time of
her death, and which was devised by her as abovementioned,
subject to the incumbrance aforesaid.

Bond required.
|
Sec. 2. And be it enacted,
That the trustee to be appointed
by the said Orphans court, before he proceeds to exercise
any of the powers to be vested in him by virtue of said appointment,
shall give bond to the state of Maryland, in such penalty
as the Orphans Court of said county shall direct, for the
faithful performance of all and singular the powers by this
act directed to be vested in him; which bond shall be recorded
by the Register of Wills [ ] for said county, and the same, or
an office copy thereof, may be put in suit by any person or
persons [intrusted] in the performance of the condition of the
same; Provided always,

Ratification required.
|
Sec. 3. And be it enacted,
That no sale made by the trustee
aforesaid, by virtue of this act, shall be good and valid, until
the same be approved of by the Orphans Court aforesaid; and
in case such sale shall be rejected by the said court, then the
said trustee shall proceed to sell again, and so from time to
time, until such sale shall be approved of by the said Orphans
Court.

Compensation—
payment over.
|
Sec. 4. And be it enacted,
That the said trustee shall be entitled
to such sum or sums of money for his expenses and trouble
in performance of the duties required by this act, as the
Orphans Court of said county shall allow him, and he is hereby
required to pay over to the persons interested, such sum
or sums as they are respectively entitled to.

CHAPTER 157.
An act to authorise the Levy Court of Kent county, to have repaired
a certain road therein mentioned.
|
Levy authorised.
|
Be it enacted by the General Assembly
of Maryland, That
the levy court of Kent county, be and they are hereby authorised
and empowered to levy on the assessable property of
said county, a sum of money, not exceeding thirty dollars, to
keep in repair the public road crossing the waste way of
Shaw's Mill.
