belong to a citizen or citizens of the state of Maryland, not
residing in Frederick county, it shall be incumbent upon the
president and directors aforesaid to give twenty days notice
to such absent citizen or citizens, by publication in one news-
paper printed in Frederick-town, and one newspaper print-
ed in the city of Baltimore, of their intention to apply for
said warrant, and that no warrant in such case shall issue till
said notice shall have been given.

CHAP. 6.

Sec. 16. And be it enacted, That if the capital of said
company shall prove insufficient, it shall and may be lawful
for the company, from time to time, to increase the same by
so many whole shares as a majority of the stockholders, at
any general meeting to be called for that purpose by the
said president and directors, shall deem necessary and pro-
per; and the said president and directors shall thereupon give
thirty days notice in at least two newspapers printed in Fre-
derick, that books will be opened to receive subscriptions
for such additional stock, in which said notice the time and
place of subscription shall be mentioned; and the books
shall be kept open for such length of time as said president
and directors shall direct, not less than two days; and dur-
ing said two days the stockholders of said company shall
have preference "over all other subscribers; and if at said
meeting a majority of the stockholders should prefer to raise
the money wanted, by loans, it shall be lawful for them so
to determine, and the president and directors shall accord-
ingly make such loans.

Sec. 17. And be it enacted, That the said canal, and the
works to be erected thereon in virtue of this act, when com-
pleted, shall for ever thereafter be esteemed and taken to be
navigable as a public highway, free for the transportation of
all goods, commodities and produce, on payment of the tolls
to be imposed as provided by this act, and no other toll or
tax whatever, for the use of said canal, and the works there-
on erected, shall at any time hereafter be imposed.

Sec. 18. And be it enacted, That there shall be a semi-
annual dividend of profits on tolls to be levied as aforesaid,
all expenses being; first deducted therefrom.

Sec. 19. And be it enacted, That the said president and
directors are hereby authorised to contract with the presi-
dent and directors of the Chesapeake and Ohio Canal Com-
pany for an intersection of the canal provided for by this
act, with any feeder of said Chesapeake and Ohio canal suit-
able to be used for canal purposes, and also for such privi-
leges and advantages in the use of the same as may be agreed
upon between the said parties; and the president and di-
rectors of the canal, provided for by this act, are hereby
vested with full right and authority to connect the same
with the Chesapeake and Ohio canal.
