and recommendation of the Adjutant General, after an in-
spection by him ordered or made of any division of the Naval
Militia, that such division so inspected is not up to the proper
standard of efficiency or discipline, the Commander-in-Chief
may, in his discretion, muster out of the service such division
so reported inefficient, and thereupon the commissions of all
officers of such division shall be vacated.

49. Any commissioned officer assigned to special duty by
the Governor, or by his authority, shall be paid per diem pay
for the time actually employed, and his necessary traveling
expenses, when such payment is authorized by the Governor.
Judge Advocates shall be paid for services in bringing any
suits provided for in this Article and for services in actions
or proceedings by habeas corpus, certiorari or otherwise, such
compensations as shall be approved by the Governor. All
staff officers shall be paid per diem for special services or-
dered by competent authority, with the approval of the Gov-
ernor. Enlisted men on duty under orders of the Governor,
but not at time serving with troops, shall receive per diem
pay, their actual traveling expenses and subsistence.

50. Whenever the Maryland National Guard or any por-
tion thereof shall be ordered out for duty, either for State
duty or in connection with the troops and forces of the
United States, then the organizations or individuals so or-
dered out and performing service shall receive the pay herein
specified for each day actually on duty. When the rate of
pay allowed by the United States is less than the amount set
forth in this Article, then the difference shall be paid out of
the militia funds of the State. The provisions of this Article
not to apply when the troops or militia forces are regularly
called or drafted into the service of the United States.

Officers, according to rank, shall be entitled to pay at the
same rate per diem that officers of like rank receive in the
service of the United States including longevity pay on the
same basis as officers of the Army. Enlisted men shall be paid
the following rates per day: Non-commissioned staff officers,
first sergeants and company quartermaster sergeants, two
dollars; sergeants, one dollar and seventy-five cents; corporals,
cooks and farriers, one dollar and fifty cents; musicians and
privates, one dollar and twenty-five cents; enlisted men of the
Naval Brigade, one dollar and twenty-five cents, except the
chief petty officers, who shall be paid as follows: Chief petty
