promotion arranged in the order of their respective qualifi-
cations as disclosed by such examination, and from such list
of appointments, promotions shall be made by the said Board
of County Commissioners of Baltimore County except ap-
pointment of the position of Marshal of Police, provided, how-
ever, they shall not place upon such list the name of any per-
son who shall be less than twenty-one years or more than forty
years of age, and said examination shall be conducted by and
under definite rules to be adopted by said examining board
from time to time and when so adopted to be recorded among
the records of the office of the County Commissioners of Balti-
more County before the holding of every examination to which
they shall be made applicable.

SECTION 438B. That the President of the Board of County
Commissioners of Baltimore County shall be the President of
said Examining Board and the Chief Clerk and Auditor of
the County Commissioners of Baltimore County shall act as
Secretary to said Board and shall keep a full and correct
record of its proceedings and of the lists prepared by it.

other duties as may be required of him by said Board of
Examiners.

SECTION 438C. That each of said members of said Exam-
ining Board shall in addition to the oath appertaining to their
respective office take the further oath or affirmation that in
examining candidates for promotion or appointment they
shall not be affected by any influence or consideration except
the physical, moral and mental considerations of the persons,
examined.

SECTION 438D... The Board of County Commissioners of
Baltimore County shall be the Trustees of the special fund
hereafter mentioned. The Treasurer of Baltimore County
shall be the Treasurer of the fund and he shall pay over and
account for all monies and property which shall come to his
hands as such Treasurer. Such trustees shall have charge of
and administer such funds and from time to time invest the
same or any part thereof as they shall deem most beneficial
and they are empowered to do all such things as are reason-
ably incident to the full and complete discharge of their
duties under this Act in reference to said fund. The said
Trustees may and they are authorized and empowered from
