CHAP. 62.

the duties required by law to be performed by the jus-
tices of the levy court for Frederick county, and the
comissioners of the tax for Frederick county.

Clerk

SEC. 5. And be it enacted. That the commission-
ers of the tax for Carroll county, shall at their annual
meeting appoint a fit and proper person, who shall
transact all the business, and discharge all the duties
appertaining to the office of clerk to the commissioners
in the same manner as the clerk of the levy court and
of the commissioners of the tax for Frederick county,

are now by law severally authorised and required to
transact the same, and the person so appointed shall
before he enters upon the duties of the office, take and
subscribe the following oath or affirmation as the case

Oath required.

may be, to wit: I. A. B. do swear or affirm that as
clerk to the commissioners of the tax for Carroll coun-
ty. I will honestly and faithfully to the best of my skill
and judgment, execute the duties of said office without
favour, affection or prejudice, so help me God; which
oath or affirmation any one of the said commissioners
is hereby authorised to administer.

Vacancy of clerk

SEC. 6. And be it enacted, That in case of a vacan-
cy occurring in the office of clerk to the commissioners
of the tax as created by this act, in consequence of
death, resignation, removal or disqtialification, the
same shall be supplied as soon thereafter as may be
practicable, in the manner prescribed by the preceding
section of this act.

Compensation

SEC. 7. And be it enacted, That the said commis-
sioners shall be entitled to receive two dollars each
per day, for every day they shall necessarily attend to
the duties of their office, and twelve and a half cents
for every mile, they may have to travel to the place of
meeting of the said commissioners, and the said clerk
to the commissioners of the tax to be appointed in vir-
tue of this act as aforesaid, shall be entitled to and re-
ceive as a compensation for his services, such sum an-
nually as the said commissioners may direct, not ex-
ceeding the sum of four hundred dollars, to be levied
on the assessable property of said county, and collected
and paid over as other county charges.

SEC. 8. And be it enacted, That the clerk of Car-
roll county court, shall annually on or before the first
Monday of March, furnish to and lay before the said
