141 ~ [11 November 1692] Court Case Francis Roberts, Plt Somerset. Wm. Cheesman of this County Planter was Contra attached to answer unto Francis Roberts of the Wm Cheesman, Dft same County in a plea of trespass on the case etc ~~ And whereupon the Plt by his Attorney James Sangster comes & says that whereas the Plt did buy one certaine Long Boat of Mr Richard Lamb mariner which said long boat with her furniture Cable & Anchor did by stress of weather break away from the said Richard Lambs shipp and so fell into the hands of the def in the same condicon she was into when she broke away from her shipp and the said plt the said Boat having purchased of the owner did demand of the said Cheesman dft tending him satisfaction for the taking up of the said boat with her furniture which said boat was of the value with her furniture of six thousand pounds of tobacco but the sd Defend’t craftily & cunningly intending to deceive & defraud the Pltf of said boat did pretend he should be fully satisfied if the plt would lend him the sd def the said boat for a small time then between them agreed and did upon himself assume & to the plt faithfully promise to bring the said boat to the plt’s landing in the same estate & condition as the deft first had her. Yett the said deft litle regarding the promise & assumption hath not brought the said Boat, but hath utterly defrauded & cousined the plt thereof. Therefore the plt sayes he is damnified & hath losse to the value of eight thousand pounds of tobacco & here upon brings this suite. Sangster Qu Pled The Decl being read anon was dismist p/ Curia
