Circuit Court of Frederick County, and upon conviction shall
be fined or imprisoned, or both, in the discretion of the Court.
The Council shall receive all election returns, and deter-
mine all questions arising thereon, and any person conceiving
himself aggrieved by reason of such decision, may appeal to the
Circuit Court for Frederick County, which shall hear and
determine the same and determine who shall pay the costs of
appeal. In case of a tie vote in any election for Mayor or
members of the Council, or on any proposition or question sub-
mitted to the voters, another election shall be held within sixty
days thereafter pursuant to the aforegoing provisions in regard
to elections. In case of a vacancy in the office of Mayor or
Councilmen by death, resignation, disqualification or removal
from the town, the Council shall, within ten days thereafter,
order a special election to fill such vacancy.

Duties of the Clerk, Treasurer and Tax Collector.

SEC. 7. The Town Clerk, who shall also be the Treasurer
and Tax Collector, shall be the custodian of the ordinance
book, the minute book, the record book and the assessment book
of the town, and he shall be entitled to receive fair compensa-
tion for all extracts or copies made by him from said books,
to be paid by the party or parties requesting such extracts or
copies, and the Mayor and Council may fix the price to be
charged by the Town Clerk for all such extracts or copies.
And the record book shall be open for the inspection of any
person interested, unless they are actually in use by the Mayor
and Council, the Town Clerk or some other officer of the town.
He shall keep a careful record of the proceedings of the Coun-
cil and record all the ordinances passed and approved, keep all
books, records, papers and documents in his safe custody, and
turn the same over to his successor in office; issue licenses and
permits and receive money therefor and make monthly re-
ports of the same. He shall file all claims and accounts pre-
sented against the town, and when the same are passed by the
Council make a record of the same and perform such other
duties as are imposed upon him by this charter, or by any ordi-
nances or order of the Mayor and Council. He shall receive
all money for taxes, water rents, licenses, fines or from other
sources, and shall credit each item and shall deposit the same
in bank to his credit as town Treasurer, subject to call of the
Mayor and Council; and he shall keep a true and accurate
account of the town's finances in well-bound books provided by
the corporation and kept exclusively for that purpose, and he
