C: To agricultural seed sold by one farmer to another: pro-
vided that if such seed is advertised for sale and is delivered
through a common carrier, then the seller shall be deemed to be
a vendor and said seed and seller shall be subject to all the re-
quirements of this Act.

104. No statements regarding the quality of any agricul-
tural seeds or mixtures, if inconsistent with the requirements
of this Act, may be written or printed on the tag or label, or
placed inside, or affixed to any container or bulk of agricul-
tural seeds of mixture sold, offered or exposed for sale or dis-
tribution, or held in possession with intent to sell for seeding
purposes within the State of Maryland.

105. Agricultural seeds shipped to any point within the
State of Maryland, for seeding purposes, shall be subject to the
provisions and requirements of this Act, and transportation
companies shall be required to see that all such agricultural
seeds, when delivered, are tagged or labeled as provided herein.

106. The duty of carrying out the provisions of this Act
shall be vested in the State Board of Agriculture of Maryland,
which Board shall be empowered to adopt such "rules and regu-
lations" as may be deemed necessary in order to secure the effi-
cient enforcement of this Act; provided that such rules and
regulations shall be issued under the title "Official Notice to
Seed Dealers, " and distributed to the seed merchants and ven-
dors of Maryland, over a definite date of distribution and indi-
cated as signed by the chief seed officer and one other repre-
sentative of the State Board of Agriculture; and further pro-
vided that such "Official Notices" shall not become effective
until 15 days after the date of each such notice. Said State
Board of Agriculture shall have authority to obtain samples of
any seed sold, offered or exposed for sale, or held in storage with
intent to sell for seeding purposes within the State of Mary-
land, and any -inspector, analyst, deputy, or other officer ap-
pointed by said Board, or its authorized representative, shall
have authority to enter any store or warehouse, room or building,
station, depot, or wharf where seeds may be sold, offered or
exposed for sale, stored, received for transportation, held for
delivery, or waylaid in transit, for the purpose of enabling
said officer or officers to inspect the labeling, collect samples for
analysis, and obtain any other information needed for the work
of the inspectors or analysts. At the time of taking of a sam-
ple there shall be made a record of the labeling and other infor-
mation desired by the inspecting officer, and a carbon copy of
