CHAPTER 61.

AN ACT to repeal Section 15 of Chapter 77 of the Acts of
1870, title "An Act to incorporate the Town of Frostburg,
in Allegany County, " and to re-enact the same with amend-
ments.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 15 of Chapter 77 of the Acts of 1870,
title "An Act to incorporate the town of Frostburg, in Alle-
gany County, " is hereby repealed and re-enacted with amend-
ments so as to read as follows:

Section 15. And be it enacted, That the Mayor and Coun-
cilmen of Frostburg may, from time to time, cause an assess-
ment to be made of all the property, real and personal, of
every kind and description, in the town of Frostburg by three
persons appointed by them, and may levy thereon a tax not
exceeding in any one year seventy-five cents on every hun-
dred dollars' worth of assessable property, that at least twelve
and one-half cents of it must be applied to the payment of
the floating debt and interest thereon until the same is paid
off and when same is fully paid then it shall be applied to
the redemption of the bonded indebtedness and interest there-
on. That twelve and one-half cents of said assessment may be
used to make permanent improvements in the said town and
when no permanent improvements are made in any year it
shall also be applied to the payment of the floating and bonded
indebtedness as aforesaid.

SEC. 2. And be it enacted, That this Act shall not become
effective unless at the town election to be held in the Town of
Frostburg on the first Tuesday in April, 1916, there shall be
cast a majority of votes in favor of increasing the tax rate
and there shall be placed on the ballots the words "For In-
crease Tax Rate" and "Against Increase Tax Rate. "

SEC. 3. And be it further enacted, That this Act is au
emergency law and necessary for the immediate preservation
of the public health and safety, and having been passed by a
yea and nay vote, supported by three-fifths of all the members
elected to each of the two houses of the General Assembly,
the same shall take effect from the date of its passage.
