32. That the Commissioners of Montgomery County, Jus-
tices of the Peace, Sheriffs, Constables and all other County and
State officers shall have, hold and exercise their offices and jur-
isdiction in said town.
33. The Town of Gaithersburg is hereby declared to be the
legal successor of the Commissioners of Gaithersburg, and shall
be entitled to and is hereby vested with all the property and
rights of every nature whatsoever belonging to the Commis-
sioners of Gaithersburg; all proceedings now pending in the
name of the Commissioners of Gaithersburg shall be continued
in such name and remain unaffected by the adoption of this
Charter. The Mayor and Councilmen and all other officers of
the town in office at the date of this Act shall hold their offices
until their successors are elected or appointed and qualified as
herein provided. All ordinances, regulations and resolutions
now in force and not inconsistent with the provisions of this
Act shall remain in force until altered or repealed by competent
authority. No provisions of this Act shall affect any right,
lien or liability subsisting on the date of its passage.
34. The Baltimore and Ohio Railroad Company is required
to keep a flagman or signalman stationed during each and every
day from 7 o'clock A. M. to 9 o'clock P. M. in each year, at
each of the crossings of its railroad over Frederick Avenue,
Chestnut Street and Summit Avenue in said town, to warn per-
sons using said streets and crossings over said railroad, at said
crossings, of the approaching of trains, cars or engines upon
said railroad.
35. No railroad company whose tracks cross any street or
public road in eaid town shall permit any of its cars to obstruct
said street or road for a longer period than five minutes.
Any such railroad company violating the provisions of this
Section, shall upon conviction thereof, before any of the Justices
of the Peace of said county, be fined not more than ten dollars
($10) and costs. In any such proceeding, service of a summons
upon any ticket agent shall be a sufficient service upon said rail-
road company.
36. All Acts and parts of Acts inconsistent with any of the
provisions of this Act are hereby repealed.
37. This Act is hereby declared to be a public Act, and may
be read in evidence in all the Courts of this State without proof.
