shall hear and determine the matter as upon appeal from a Jus-
tice of the Peace; provided, however, that the Justices of the
Peace residing in said town shall have the same power to hear,
try and determine all criminal cases where the Town of
Gaithersburg is a party as they now have in cases where the
State of Maryland is a party.

22. The Bailiff shall have the same fees for making distress
or levying executions as are allowed for like services by the laws
of the State, and for making arrests or serving process for the
violation of any ordinance of the corporation the same fees aa
are allowed constables for the similar services.

23. All fines, penalties and forfeitures imposed by this Char-
ter or by any ordinance of the Council may be collected in the
name of the Town of Gaithersburg before the Mayor or any
Justice of the Peace in the same manner as small debts are col-
lected, and the delinquent shall be committed to the town lockup
or County Jail until the same is paid with costs.

24. The County Commissioners of Montgomery County shall
annually pay the Town of Gaithersburg the total amount of
road tax collected by said County within the Town of Gaithers-
burg according to the tax books of said County.

25. The Council shall have the same powers as the State
Board of Health of this State, restricted, however, to the limits
of the town.

26. The Council may appoint a scavenger, and prescribe his
duties and fix his compensation, which shall be paid by the
Council out of the general fund or by a special tax for that
purpose, to be imposed on the occupants of the respective build-
ings and collected as other taxes are collected; provided, never-
theless, that the owner or owners of property shall be responsible
for said taxes in case the same can not be collected from the oc-
cupants thereof; and the Council may pass suitable ordinances
to enable said scavenger to remove all filth from the town, and
may require of said scavenger a bond for the faithful perform-
ance of his duties; provided, however, that said special tax shall
not exceed fifty cents per month on any one house, to be paid
by the owner or occupant thereof, as aforesaid.

27. The Council shall keep and annually publish or post a
tabular statement of the receipts and expenditures of the funds
of the corporation, and such other matters connected with the
