affected by their decision, he may Appeal to the Circuit Court
for Wicomico County, by giving written notice within twenty
days from said decision, filed with the Clerk of the Board of
Commissioners, of his desire to appeal; and on the filing of said
notice, it shall be the duty of the Clerk to deliver the papers
connected therewith to the Clerk of said Court, and the same
proceedings shall be had on the appeal as in cases of appeal
from judgment of Justice of the Peace; provided, nevertheless,
that the Board of Commissioners may decline to open, lay out,
extend, widen, grade or straighten any street, alley or highway,
or any square, waterway or drain, notwithstanding the decision
of said Court; but in case of refusal to do so, they shall be
liable for all costs incurred, and shall pay the same. All benefits
assessed by virtue of the above provisions shall be liens on the
respective lots or parcels of ground on which they are assessed,
from the time of the final ratification of the aforesaid return,
and shall be collected as taxes are collected, or may be collected
by action at law. On appeal, the Court or jury may alter the
award so returned, whether of damages or benefits, and award
costs in its discretion.
SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 303.
AN ACT to correct the rank of Captain Carroll Edgar, Ordnance
Department, Maryland National Guard.
WHEREAS, Captain Carroll Edgar, formerly Captain of Com-
pany "E," First Maryland Infantry, located at Elkton, Mary-
land, did remove his residence from said town of Elkton, to
Baltimore, Maryland, in the Fall of 1912, and in consequence
thereof, resigned as Captain of said Company, and received a
"Full and Honorable Discharge," dated January 7th, 1913, and
WHEREAS, The said Captain Carroll Edgar was appointed
Ordnance Officer of the Fifth Jnfantry, Maryland National
Guard, but on account of delay in filing the necessary papers,
his Probationary Commission, as Captain, Ordnance Depart-
ment, was not dated until January 27th, 1913, leaving an inter-
val of twenty days between said "Full and Honorable Dis-
charge," and said Probationay Commission, as Captain, Ord-
nance Department, Maryland National Guard.
