six feet along the west side of Park Street to a concrete post at
the intersection of the south side of Chestnut Street; thence north
10° and 43' east ten hundred and eighty-two feet to a stake on
the Delaware and Maryland Division Line; thence by and with
said division line in an easterly direction seven hundred and
forty-seven feet to the place of beginning.
SEC. 23. And be it enacted, That the government of the said
town shall be vested in five Commissioners to be elected as here-
inafter provided, who shall be taxpayers, and qualified voters
of the town for twelve months next preceding their election,
and shall hold their office for a term of two years, except as here-
inafter provided, or until their successor or successors are ap-
pointed or elected and qualified, provided that three of the
Commissioners elected at the first election held under this Act,
which three shall be determined by lot at the first regular meet-
ing of the Commissioners of Delmar, shall hold their office for
a term of one year only; and provided that at every subsequent
election of Commissioners under this Act, three Commissioners
shall be elected, two of whom shall hold office for the term of
two years, and one of whom shall hold office for the term of one
year as aforesaid shall be determined by lot at the first regular
meeting of the Commissioners of Delmar after the said election.
SEC. 27. And be it enacted, That at their regular meeting
after the annual election and the qualification of the newly-
elected members, or as soon thereafter as practicable, the Com-
missioners shall elect one of their members as President and one
of their members as Clerk and one of their members as Treas-
urer, and at their second regular meeting they shall appoint not
more than three persons as Bailiffs for said town who shall not
be members of the Board of Commissioners, and they may elect
and appoint counsel and give him such compensation as may
be agreed upon; one and the same person may act as Clerk and
Treasurer, and one of the Bailiffs may be Collector of taxes;
either of the above-named officers shall be subject to removal
by a vote of a majority of the whole number of Commissioners,
and the Commissioners shall prescribe their duties and fix their
compensation by ordinance when not otherwise prescribed by
this Act.
SEC. 31. And be it enacted, That the Bailiffs, before entering
upon their duties, shall subscribe to an oath for the faithful
performance of their duties for the enforcement of the ordi-
nances of the town and the preservation of its peace and good
order; they shall be vested with all the police powers of a con-
