1364 LAWS OF MARYLAND.

River should be transplanted in non-polluted waters before
offering for shipment, so as to escape liability under the Pure
Food and Drugs Act, June 30, 1908; and

WHEREAS, The said pollution is a direct and serious menace to
the health of the inhabitants of Annapolis and vicinity, as well
as being objectionable on account of the interstate shipment of
oysters from this locality; and

WHEREAS, The State of Maryland, through its large property
holdings in the City of Annapolis, largely contributes to the
objectionable conditions aforesaid through its use of the sewers
of said city; and

WHEREAS, The United States Government, through its institu-
tion at the Naval Academy, also largely contributes to the cause
of said pollution of said Severn River, and also the said City of
Annapolis, and have inaugurated a movement to remedy said
conditions by construction of a sewerage disposal plant; there-
fore,

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the Board of Public Works of Maryland, be, and
they are hereby, authorized and empowered to co-operate with
the United States Government and the City of Annapolis for
the purpose of having constructed a sewerage disposal plant for
said city, and to take such action to this end as may in their
judgment and discretion be advisable, proper and necessary.

SEC. 2. And be it enacted, That for the purpose of carrying
out the provisions of this Act the sum of Fifty Thousand Dol-
lars, or so much thereof as may be necessary, be and the same
is hereby appropriated from any moneys in the Treasury not
otherwise appropriated, to be expended under the direction of
the said Board of Public Works; provided, however, that none
of the moneys hereby appropriated shall become available until
the City of Annapolis shall have first submitted to the said
Board of Public Works a legal and binding contract for a proper
and sufficient disposal or sewerage plant for the needs of said
City and vicinity, and that said City has made financial provi-
sion including this appropriation to fully complete and equip
said sewerage disposal plant.

SEC. 3. And be it enacted, That this Act shall take effect
from the date of its passage.
