1256 LAWS OF MARYLAND.

with the next highest number of votes, the one to hold office for
one year shall be publicly determined by lot after due notice
as aforesaid. At the election to be held in April, 1915, there
shall be one Commissioner elected for a period of three years
and one Commissioner for a like period each year thereafter.
Said election shall be held annually on the fourth Monday of
April at such place in said town as shall be designated by the
Commissioners between the hours of two and five o'clock P. M.
The Commissioners shall give at least two weeks' notice of the
election in one or more newspapers published in Caroline Coun-
ty, and by such other means as they may elect; and they shall
appoint three Judges of Election, the Judges shall keep a record
of the persons voting and the persons voted for, and the
persons having the highest number of votes shall be declared
duly elected; the Judges of Election shall notify the persons
elected of their election, and the persons so elected shall sever-
ally hold their respective offices from the second Monday of
May next ensuing the election for and during the terms re-
spectively of three, two and one year, and until their successors
shall be elected and qualified. Said Judges shall conduct such
election in accordance with the ordinance prescribing same,
which shall require them to make return to the Commissioners
and provide for the preservation of the ballots for a period of
four months. If notice of such election shall not be given as
hereinbefore required, or if the Judges of Election shall not be
appointed or shall refuse to act, five or more voters of said town
may call the election of said officers by notices set up in at least
four of the most public places in said town, not less than one
week previous to said election, therein naming the time and
place to hold such election and naming three Judges thereof,
who, or any two of whom may hold such election and have the
same powers in respect thereto as the Judges appointed by the
Commissioners.

SEC. 75. And be it further enacted, That if at any election
for Commissioners there shall be a tie vote between any candi-
dates for the same office, a new election shall be held, or if any
person elected to the office of Commissioner shall refuse to act,
die, resign, be disqualified or remove beyond the corporate limits
of said town, the remaining Commissioners shall elect a succes-
sor to serve until the next election, at which said time a Commis-
sioner shall be elected to fill the unexpired term caused by said
vacancy. Said Commissioner elected as aforesaid shall qualify
as the other members.
