158-E-1. And be it enacted, That the Mayor and Council
of Salisbury shall have charge of all the streets and alleys of
the said City, but shall in no manner be responsible for the
maintenance or control of the five bridges across the branches
of the Wicomico River, which shall be and remain under the
control of the County Commissioners of Wicomico County.

When any mill dam within the limits of the City of Salisbury
has been or shall be acquired as a public street or highway,
and there is a flumeway or passage for water from the dam to
a mill, or other place where the water power is used, on the
opposite side of such street or highway, such flumeway shall be
constructed throughout the distance that it passes through the
said street in a safe and substantial manner, and the bridge
over the same shall be constructed in a safe and substantial
manner, and both shall be maintained in good and safe condi-
tion, by the owner of such dam at his own expense, and such
owner shall be liable for any damage or injury caused by the
negligence of such owner in constructing or maintaining the
same. And the Mayor and Council of Salisbury may pass or-
dinances for the enforcement of these provisions and provide
appropriate fines and penalties for non-compliance therewith.
And the owner of any such dam, mill, or other place where such
water power is sused may after one month's notice to the Mayor
and Council, abandon such flumeway by written notice deliv-
ered to the Clerk of Salisbury. After such notice the said Mayor
and Council of Salisbury shall have full control of the street
or highway over all the said dam as other streets or highways
in said City.

The Mayor and Council of Salisbury shall have power to
make by-laws and to pass ordinances to establish grades for
the streets, gutters and sidewalks of the City, the width thereof
and the material of which they shall be built; and to make
by-laws and to pass ordinances for causing the sidewalks along
any public street or highway to be graded, curbed, paved, re-
paved or improved at the cost and expense of the owners of the
abutting property which cost shall be a lien on the abutting
property and recoverable by action at law or as taxes are
collected; provided that, before assessing the costs of any such
grading, curbing, paving, repaving or improving on any prop-
erty, the Mayor and Council of Salisbury shall give at least
ten days' notice in one or more newspapers published in the
City of Salisbury of their intention to make such assessment
and of the time and place where objections thereto will be
