debts are now recovered; but if the party tres-
passed upon shall kill, maim or otherwise wilfully
injure the stock trespassing, he shall forfeit his
right to recover, but in case of prosecution for such
killing or maiming, he shall be entitled to prove
the amount of damage done by such stock, in miti-
gation of damages for the killing or maiming.
 

CHAPTER 268.

6, 1862.

AN ACT amendatory of the act passed at Decem-
ber session, eighteen hundred and forty-six,
chapter two hundred and thirty-four, entitled,
a supplement to an act concerning the Annapo-
lis and Elkridge Railroad Company, passed at
December session, eighteen hundred and forty-
one, chapter one hundred and sixty-eight.

Preamble.

WHEREAS, by the act passed at December session,
eighteen hundred and forty-six, chapter two
hundred and thirty-four, the Annapolis and
Elkridge Railroad Company were authorized to
issue bonds of said Company to John Higham,
for the sum of nine thousand and ninety-two
dollars and sixty cents, in full of the balance
due on a judgment recovered by said John
Higham against said Company, which said
bonds were to be paid in like manner as the
bonds issued under the original act ; and
whereas, by the construction placed on the pro-
viso to said act, the State Treasurer has with-
held from the said John Higham and his repre-
sentatives, the interest due upon said bonds,
contrary to the manifest intention of the Legis-
lature in passing said act ; therefore,

pay interest on
bonds, &c.

SECTION 1 . Be it enacted by the General Assembly
of Maryland, That the Treasurer of the State pay
to the representatives and assigns of the said John
Higham, out of the profits particularly assigned
in the second section of the said act of December
