Sec. 3. And be it enacted, if any person shall
injure or cause, to be injured, defaced or destroyed,
any dam, reservoir, line of conduit, water pipe,
gate-house, stop cock, or other thing, used for sup-
plying the city of Baltimore with water, the per-
son so offending shall forfeit and pay a sum not less
than five, nor more than fifty dollars for each
offence.

Dams, reser-
voirs, &c.

Sec. 4. And be it enacted, That all fines and
forfeitures imposed by this act, shall be recoverable
by warrant, before any Justice of the Peace, in
and for the city of Baltimore, or in and for Balti-
more county, according to the respective jurisdic-
tion under which any of the offences herein set
forth may be committed ; one-half to the informer,
and the other half to the Mayor and City Council
of Baltimore.

Fines and for-
feitures — how
recoverable.

Sec. 5. And be it enacted, That this act shall
not be construed to exempt any person or persons
who may have been fined for a violation thereof,
or who may be charged with a violation thereof,
from an action of damages for any injury or de-
struction of any part of the works used in supply-
ing the city of Baltimore with water, in any suit
for damages on account of said injury, brought by
the Mayor and City Council of Baltimore.

Construction.

Sec. 6. And be it enacted, That this act shall
take effect from the day of its passage.

SECTION 1 . Be it enacted by the General Assembly
of Maryland, That any person or persons, throw-
ing, putting or placing lime, or any other poison-
ous substances, into any of the creeks, streams of
