Repealed.

Sec. 3. And be it enacted, That section one hun-
dred and eighty-five of said Article be repealed,
and the following enacted in lieu thereof:

185. All appraisements for damages to sheep,
shall be filed in the office of the county commis-
sioners, and shall be paid according to priority of
date; provided, that no appraisement shall be
paid, unless filed within three months of the date
when the sheep were killed or injured, nor unless
the owner of said sheep, shall make affidavit, to
be filed with the appraisement, that said sheep
were killed or injured by a 3og or dogs not owned
or harbored by him, and that he has no means of
recovering the value thereof from the owner or
owners of the dog or dogs that killed or injured
them.

Repealed.

Sec. 4. And be it enacted, That section one hun-
dred and eighty-eight of said Article be repealed
and the following enacted in lieu thereof:

tax on dogs;

tor.

188. If any owner or keeper of an assessed dog
shall be unable or unwilling to pay the tax here-
on, and the collector can find no property'out of
which to make the tax, the collector shall forth-
with proceed to kill said dog or dogs, and shall be
allowed for each and every dog he shall kill, the
sum of twenty-five cents, to be paid out of the
fund arising from the tax on dogs.

Sec. 5. And be it enacted, That this act shall
take effect from the date of its passage.
