wagon or carriage, or carriages of burthen what-
soever, shall be drawn along the said road with a
greater weight than is hereby allowed, the owner
or owners of such carriage, if the excess of bur-
then shall be three hundred weight or upwards,

shall forfeit and pay four times the ordinary tolls
for the use of the company; provided, always, that
it shall and may be lawful for the said company,
by their by-laws, to alter any or all the regula-
tions herein contained respecting the burthens or
carriages to be drawn over the said road, and to
substitute other regulations, if upon experiment
such alterations shall be found conducive to the
public good; provided, nevertheless, that such reg-
ulations shall not lessen the burthens of carriages
above described.

Governor to
be notified.
|
Sec. 13. And be it enacted, That as soen as the
President and Directors of said company shall
have perfected the said road for a distance of two
and a half miles, and so on from time to time any
other like distance progressively, they shall give
notice thereof to the Governor of this State, who
shall thereupon forthwith nominate and appoint
three skillful and judicious persons to view and
examine the same, and report to him in writing
whether the said road is so far extended in a work-
manlike manner, according to the true intent and
meaning of this act; and if their report shall be
in the affirmative, then the Governor shall, by li-
cense under his hand and seal of the State, per-
mit and suffer the said President and Directors to
erect and fix such and so many gates or turnpikes
upon and across the said road as will be necessary
and sufficient to collect the tolls hereinbefore
granted to the said company.

Road to be kept
in good order
|
Sec. 14. And be it enacted, That if the said com-
pany, after the said road is completed as aforesaid,
shall neglect to keep the said road in good and
perfect order for the space of fifteen days, and
information shall be given to any Justice of the
Peace of the neighborhood within the county
where the repair ought to be made, such Justice
shall issue a precept, to be directed to any con-
stable, commanding him to summon three disin-
terested persons, to be named by the said Justice
in the said precept, to meet at a certain time, in
the said precept to be mentioned, at the place in
