Sec. 19. And be it enacted That the said Balti-
more and Pikesyille (Railway Company shall com-
mence the construction of said railway within
ninety days-from the time this act shall take effect,
and complete the same within twelve months from
its commencement.

Sec. 20. And be it enacted, That the said Balti-
more and Pikesville railway company, be, and they
are hereby required to reduce the grade of the two
hills, the, on e near the second mile stone, known
as "Long Hill, "the other near the three mile stone,
known as "Stony Hill," on the said turnpike road,
eleven feet each, below their present grade.

Sec. 21. And be it enacted, That the said rail-
road company shall construct a good and substan-
tial iron railway, but the guage of said road shall
be the same, as that of the Baltimore City Passen-
ger Railway, and further the said railway com-
pany be and they are hereby reqired to purchase
the omnibus horses and equipments from the pro-
prietor or proprietors of the omnibus line now run-
ning on the said Baltimore and and Reisterstown

turnpike from Baltimore City to Pikesville: pro-
vided, that in case of any dispute as regards price
between the parties, the matter shall be submitted
to arbitration.

Proviso.

Sec. 22. And be it enacted, That this act shall
take effect and have full operation, only on condi-
tion that the President, Managers and Company
of the Baltimore and Reisterstown turnpike road
company do not carry into effect the act authoriz-
ing and empowering them to lay a track of iron
railway on their said road, but this act to take
effect and have full force and operation immediately
after the failure of the said Reisterstown Turnpike
Company, to carry into effect this said act; and
that this act shall not take effect, unless the act
to authorize the Reisterstown Turnpike Company
to build a railway in the turnpike is passed by
this General Assembly.

Sec 23. And be it enacted, That the Legislature,
hereby reserves to itself the right to alter, amend
or repeal this act or any part thereof.
