amount of the capital stock, by like notice as that
required for annual meetings, specifying moreover
the object of the meeting; but no business shall
be transacted at such special meeting unless a
majority, in value, of the stockholders shall at-
tend in person or by proxy.

Authorized to
locate road.

Sec. 12. And be it enacted, That the said com-
pany be and they are hereby authorized to locate
and construct a railroad from some convenient
point at the limits of the city of Baltimore, to be
selected by them, to Pikesville, Baltimore county,

Provided.

over the Reisterstown turnpike road, or such other
route as they may select; provided, however, that
in locating and constructing said railway, the
company shall not deviate more than fifty feet
from the bed of said Reisterstown turnpike road;
and they may enter upon said turnpike road, or
upon any land necessary for laying out, locating
or making the said road, as provided for within
this section, and may procure gravel, earth, wood
or timber for such use, and obtain the right to the
same as hereinafter provided.

Sec. 13. And be it enacted, That the President
and Directors of said company may agree with
the Turnpike Company, or the owner or owners
of any lands, earth, gravel, timber or other ma-
terials, or any improvements for the construction
or repair of any said road, or its works, for the
purchase or use and occupation of the same; and
in case they cannot agree, or if the owner or
owners be a feme covert non-compos mentis, or out
ot the State, on application to a Justice of the
Peace of Baltimore county, he shall issue his war-
rant, under his hand and seal, directed to the
Sheriff of said county, requiring him to summon
a jury of twelve men, inhabitants of said county,
not related or anywise interested in the premises,
to meet on the land to be valued, on a day to be
specified in said warrant, not less than five nor
more than ten days after issuing the same; and in
case any of the jurors aforesaid do not attend, the
Sheriff shall instanter summons as many jurors as
may be necessary, with the jurors in attendance,
to finish a panel of twelve jurors, who shall act
in the premises, and the Sheriff shall administer
to each of them an oath or affirmation, as the case
may be, that he will justly and impartially value
