for, it shall be competent for any ten shareholders
to call such: meeting and hold duch election.; and
at every election the stockholders present shall
appoint the judges of election, and the President
and Directors shall annually make to the stock-
holders, a statement of the affairs of the company,
and make a dividend of the profits, if any.

Sec. 5. And be it enacted, That the company
hereby incorporated, shall have power to construct
a railway with one or two tracks, and the neces-
sary sidlings, and have the exclusive use of the
same, commencing at the Northern boundary oi
the city of Baltimore, at the same point thereon
East of Jones' Falls, running thence to Hunting-
don avenue or to Mankin's lane, then to and
through the Hampden property to the Hampden
Reservoir, then round said reservoir to some point
on the West side of Jones' Falls, and terminating
at an entrance to Druid Hill Park, on the East
side of said park, at some point which may be
agreed upon by the said company and the Com-
missioners of said park, but if said park should be
extended to the East side of Jones' Falls, then
said railway shall terminate at an entrance agreed
upon, as aforesaid, on the East side of Jones'

Falls ; provided, that the said park shall be so ex-
tended before the completion of the railway to
the point first mentioned.

Proviso.

Sec. 6. And be it enacted, That the said com-
pany shall have power to lay its rails upon any
streets, avenues and roads in Baltimore county,
which are now, and which may be graded, paved
or opened before the completion of the railway
and to open any new road or roads ; and to widen
any existing road or roads which may be neces-
sary, so that the rails and carriage way together,
shall not exceed forty feet in width.

Sec. 7. And be it enacted, That in case the said
company shall not be able to agree with the owner
or owners of any land required for said railway
or in case they or any of them be a feme covert
under age, non compos mentis, or absent, on appli-
cation to a Justice of the Peace of Baltimon
county, he shall -issue his warrant, under his hand
and seal, directed to the Sheriff of said county
requiring him to summon a jury of twenty inhabi-
